Sipas vendimit t\u00eb marr\u00eb m\u00eb 2 prill 2025 i cili u b\u00eb publik t\u00eb nj\u00ebjt\u00ebn dit\u00eb, me 13 dhjetor 2024 e po ashtu edhe me 14 shkurt 2025, trupi gjykues kishte shtyr\u00eb vendimin p\u00ebr pranimin e deklaratave t\u00eb d\u00ebshmitarit W04858 si dhe kishte refuzuar pranimin e d\u00ebshmis\u00eb s\u00eb W02172.<\/p>\n

Nj\u00eb k\u00ebrkes\u00eb t\u00eb ngjashme, ZPS-ja e kishte b\u00ebr\u00eb edhe n\u00eb 7 mars 2025 por q\u00eb p\u00ebr d\u00ebshmitarin W04858 kishte k\u00ebrkuar edhe masa mbrojt\u00ebse, raporton \u201cBetimi p\u00ebr Drejt\u00ebsi\u201d.<\/p>\n

Me 19 mars, n\u00eb k\u00ebrkes\u00ebn e ZPS-s\u00eb ishin p\u00ebrgjigjur ekipet mbrojt\u00ebse. Nd\u00ebrsa kund\u00ebrp\u00ebrgjigja e ZPS-s\u00eb ishte dor\u00ebzuar me 24 mars. N\u00eb t\u00eb nj\u00ebjt\u00ebn dit\u00eb, mbrojtja kishte k\u00ebrkuar pranimin e nj\u00eb deklarate shtes\u00eb p\u00ebr d\u00ebshmitarin W02172 gj\u00eb e cila ishte pranuar nga trupi gjykues.<\/p>\n

N\u00eb k\u00ebrkes\u00ebn e saj, ZPS-ja kishte p\u00ebrmendur faktin q\u00eb gjyqtaret kishin konstatuar p\u00ebr d\u00ebshmitarin W02172 se provat n\u00eb lidhje me t\u00eb jan\u00eb t\u00eb r\u00ebnd\u00ebsishme dhe autentike por q\u00eb ato u refuzuan q\u00eb t\u00eb pranohen sipas rregull\u00ebs 153 do t\u00eb kishin efekt m\u00eb shum\u00eb d\u00ebmtues s\u00eb sa vler\u00eb provuese.<\/p>\n

Sipas vendimit, trupi gjykues kishte th\u00ebn\u00eb se intervista e k\u00ebtij d\u00ebshmitari kishte t\u00eb b\u00ebnte me persona q\u00eb dyshohen se jan\u00eb ndaluar n\u00eb objektin e paraburgimit n\u00eb Llapashtic\u00eb si dhe nd\u00ebrveprimin q\u00eb ka pasur d\u00ebshmitari me an\u00ebtar\u00eb t\u00eb ndrysh\u00ebm t\u00eb U\u00c7K-s\u00eb.<\/p>\n

N\u00eb k\u00ebrkes\u00ebn e saj, ZPS-ja ka th\u00ebn\u00eb se pasi ky material tani \u00ebsht\u00eb dor\u00ebzuar me redaktime, vlera provuese e deklarat\u00ebs s\u00eb d\u00ebshmitarit n\u00eb fjal\u00eb nuk ka efekt t\u00eb d\u00ebmsh\u00ebm dhe se ajo duhet t\u00eb pranohet sipas rregull\u00ebs 153.<\/p>\n

Mbrojtja kishte th\u00ebn\u00eb se kjo deklarat\u00eb nuk duhet t\u00eb pranohet sipas rregull\u00ebs 153 me arsyetimin se rr\u00ebfimet e W02172 mbi struktur\u00ebn e U\u00c7K-s\u00eb dhe politik\u00ebn e supozuar t\u00eb saj p\u00ebr nd\u00ebshkimin e bashk\u00ebpun\u00ebtoreve p\u00ebrb\u00ebjn\u00eb elemente inkiminuese dhe jan\u00eb t\u00eb mosp\u00ebrputhese me d\u00ebshmin\u00eb e saj lidhur me t\u00eb nj\u00ebjt\u00ebn \u00e7\u00ebshtje.<\/p>\n

N\u00eb vendim thuhet se s\u00ebrish trupi gjykues \u00ebsht\u00eb i mendimit se provat e propozuara t\u00eb d\u00ebshmitarit W02172 jan\u00eb autentike ngjash\u00ebm si kishte konstatuar n\u00eb vendimin paraprak. Sipas tyre, provat e propozuara plot\u00ebsojn\u00eb deklaratat e d\u00ebshmitarit W02172 pasi ofrojn\u00eb korrigjime dhe sqarime t\u00eb r\u00ebnd\u00ebsishme.<\/p>\n

Ve\u00e7 k\u00ebsaj, trupi gjykues ka dal me konstatimin se provat e propozuara mb\u00ebshteten edhe nga d\u00ebshmitar\u00eb t\u00eb tjer\u00eb t\u00eb cil\u00ebt mbrojtja e ka pasur mund\u00ebsin\u00eb q\u00eb t\u2019i ballafaqoj\u00eb. Si rrjedhoj\u00eb, \u00ebsht\u00eb konstatuar se k\u00ebto prova kan\u00eb vler\u00eb provuese.<\/p>\n

N\u00eb vendim thuhet se serish edhe k\u00ebt\u00eb her\u00eb, trupi gjykues mban q\u00ebndrim se provat e propozuara t\u00eb d\u00ebshmitarit W02172 jan\u00eb relevante dhe autentike. Gjithashtu, u konstatua se jan\u00eb b\u00ebr\u00eb redaktime e k\u00ebrkuara n\u00eb vendimet e m\u00ebparshme.<\/p>\n

Nd\u00ebrsa, p\u00ebr d\u00ebshmitarin W04858, trupi gjykues e kishte shtyr\u00eb vendimin p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb n\u00ebnshkrimit nga ana e d\u00ebshmitarit ndon\u00ebse d\u00ebshmia e tij ishte vler\u00ebsuar si relevante, autentike, ka vler\u00eb provuese dhe nuk ishte paragjykues.<\/p>\n

Pasi d\u00ebshmitari ka n\u00ebnshkruar deklarat\u00ebn dhe nj\u00eb dokument me korrigjime, ZPS-ja k\u00ebrkoi serish pranimin n\u00eb prova materiale t\u00eb k\u00ebsaj d\u00ebshmie si dhe kishte propozuar q\u00eb d\u00ebshmitarit t\u00eb iu vihen masat mbrojt\u00ebse.<\/p>\n

Paneli ka konstatuar se k\u00ebrkesat sipas rregull\u00ebs n\u00eb fjal\u00eb jan\u00eb p\u00ebrmbushur si dhe ka konstatuar se provat q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me d\u00ebshmin\u00eb e d\u00ebshmitarit W04858 jan\u00eb t\u00eb pranueshme.<\/p>\n
