Gjykata Themelore n\u00eb Prishtin\u00eb e ka konfirmuar aktakuz\u00ebn Prokuroris\u00eb Speciale t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs (PSRK) ndaj Ilir Abdullahut, i cili akuzohet se n\u00eb bashk\u00ebrkyerje me Arben Berish\u00ebn, Fitim Avdiun, Enver Sekiraq\u00ebn dhe Rrahim Abdullahun, kan\u00eb vrar\u00eb ish-policin Triumf Riza.<\/strong><\/p>\n\n\n\n

Ilir Abdullahu n\u00eb shqyrtimin fillestar m\u00eb 18 shtator 2024 ishte deklaruar i pafajsh\u00ebm, duke th\u00ebn\u00eb se nuk e pranon nj\u00eb aktakuz\u00eb t\u00eb ngritur me thashetheme, raporton \u201cBetimi p\u00ebr Drejt\u00ebsi\u201d.<\/p>\n\n\n\n

Pas mbajtjes s\u00eb shqyrtimit fillestar, i akuzuari Abdullahu p\u00ebrmes mbrojt\u00ebsit t\u00eb tij, avokatit Ram\u00eb Dreshaj kan\u00eb paraqitur k\u00ebrkes\u00eb p\u00ebr hudhje t\u00eb aktakuz\u00ebs dhe kund\u00ebrshtim t\u00eb provave. Por, Themelorja ka marr\u00eb vendim, me t\u00eb cilin ka konfirmuar aktakuz\u00ebn.<\/p>\n\n\n\n

Pretendimet e mbrojtjes s\u00eb t\u00eb akuzuarit Abdullahu:<\/p>\n\n\n\n

N\u00eb pretendimet e k\u00ebrkes\u00ebs s\u00eb mbrojtjes, thuhet se aktakuza nuk \u00ebsht\u00eb mb\u00ebshtetur n\u00eb prova t\u00eb cilat do t\u00eb argumentonin besueshm\u00ebrin\u00eb e aktakuz\u00ebs dhe se nuk ka prova q\u00eb do t\u00eb argumentonin dyshimin e bazuar mir\u00eb se Abdullahu ka kryer vrasjen si\u00e7 pretendohet.<\/p>\n\n\n\n

Gjithashtu, mbrojtja ka pretenduar se provat q\u00eb sipas tyre jan\u00eb nxjerr\u00eb me dhun\u00eb dhe presion n\u00eb procedur\u00eb parapenale nga nj\u00eb hetues policor, v\u00ebrtetojn\u00eb pik\u00ebrisht t\u00eb kund\u00ebrt\u00ebn p\u00ebr \u00e7ka flet aktakuza.<\/p>\n\n\n\n

Sipas mbrojtjes, n\u00eb dispozitivin e aktakuz\u00ebs nuk dihet se a \u00ebsht\u00eb fjala p\u00ebr hakmarrje apo p\u00ebr ndonj\u00eb motiv tjet\u00ebr.<\/p>\n\n\n\n

Gjithnj\u00eb sipas mbrojtjes, Abdullahu pretendohet t\u00eb ket\u00eb kryer vrasjen ndaj Triumf Riz\u00ebs n\u00eb bashk\u00ebkryerje me Arben Berish\u00ebn, Fitim Avdiun dhe Rrahim Abdullahun, por se nuk dihet se t\u00eb gjith\u00eb bashk\u00ebrisht apo ndonj\u00ebri prej tyre ka pasur motiv t\u00eb hakmarrjes ndaj Triumf Riz\u00ebs dhe se n\u00eb kontest t\u00eb hakmarrjes apo motiveve tjera, nuk p\u00ebrmendet i d\u00ebnuari Enver Sekiraqa.<\/p>\n\n\n\n

Po ashtu, mbrojtja ka pretenduar se n\u00eb aktakuz\u00eb \u00ebsht\u00eb e gabuar edhe ora ku pretendohet se Abdullahu ka pranuar mesazhin \u201cparking te Grandi komshia e kish dram\u00ebn\u201d (duke aluduar p\u00ebr Triumf Riz\u00ebn), pasi q\u00eb n\u00eb aktakuz\u00eb ndaj Sekiraq\u00ebs mesazhi thuhet t\u00eb jet\u00eb i d\u00ebrguar n\u00eb ora 14:06 minuta, nd\u00ebrsa n\u00eb at\u00eb ndaj Abdullahut n\u00eb 13:02 minuta.<\/p>\n\n\n\n

Provat e siguruara n\u00eb procedur\u00ebn hetimore gjat\u00eb vitit 2007, sipas mbrojtjes, duhet t\u00eb ve\u00e7ohen nga shkresat e l\u00ebnd\u00ebs, pasi q\u00eb sipas tyre jan\u00eb qartazi t\u00eb pamb\u00ebshtetshme dhe nuk jan\u00eb n\u00eb harmoni me dispozitat ligjore t\u00eb Kodit t\u00eb Procedur\u00ebs Penale.<\/p>\n\n\n\n

Po ashtu, mbrojtja ka k\u00ebrkuar q\u00eb nga shkresat e l\u00ebnd\u00ebs t\u00eb ve\u00e7ohen deklaratat e d\u00ebshmitar\u00ebve: Besnik Hasani, Shpend Qerimi, Abedin Canolli, Besarta Mexhuani, Kaltrina Berisha, Faton Shoshi, Mona, Zanfina dhe Ema Ismajli, deklarata e t\u00eb d\u00ebmtuarvae: Adelina Ismjali dhe Emine Zeqiri.<\/p>\n\n\n\n

Gjith\u00eb kjo, pasi q\u00eb sipas mbrojtjes dh\u00ebnia e deklaratave n\u00eb procedur\u00eb parapenale hetimore ka qen\u00eb n\u00eb kund\u00ebrshtim me Kodin e Procedur\u00ebs Penale, me arsyetimin se t\u00eb nj\u00ebjtat jan\u00eb marr\u00eb n\u00ebn presion, mashtrim dhe k\u00ebrc\u00ebnim nga ana e hetuesve asokohe.<\/p>\n\n\n\n

P\u00ebrgjigja e PSRK-s\u00eb ndaj pretendimeve t\u00eb mbrojtjes s\u00eb Abdullahut:<\/p>\n\n\n\n

Lidhur me k\u00ebto pretendime, sipas vendimit t\u00eb Gjykat\u00ebs, Prokuroria Speciale ka ofruar p\u00ebrgjigje duke propozuar q\u00eb t\u00eb refuzohet k\u00ebrkesa e mbrojtjes p\u00ebr hudhje t\u00eb aktakuz\u00ebs dhe kund\u00ebrshtimit t\u00eb provave.<\/p>\n\n\n\n

Sipas PSRK-s\u00eb, aktakuza \u00ebsht\u00eb ngritur pas nj\u00eb hetimit t\u00eb plot\u00eb dhe gjith\u00ebp\u00ebrfshir\u00ebs ku jan\u00eb mbledhur prova t\u00eb r\u00ebnd\u00ebsishme materiale dhe d\u00ebshmi t\u00eb d\u00ebshmitar\u00ebve dhe se sipas Prokuroris\u00eb nga veprimet e Abdullahut manifestohet se e ka kryer vepr\u00ebn penale p\u00ebr \u00e7ka akuzohet.<\/p>\n\n\n\n

Gjetjet e Gjykat\u00ebs Themelore n\u00eb Prishtin\u00eb:<\/p>\n\n\n\n

Sipas Themelores, bazuar n\u00eb shkresat e l\u00ebnd\u00ebs dhe provat n\u00eb t\u00eb cilat \u00ebsht\u00eb mb\u00ebshtetur aktakuza, ekzistojn\u00eb prova t\u00eb mjaftueshme t\u00eb cilat v\u00ebrtetojn\u00eb dyshimin e bazuar mir\u00eb n\u00eb k\u00ebt\u00eb faz\u00eb t\u00eb procedur\u00ebs penale.<\/p>\n\n\n\n

Gjithashtu, Gjykata sqaron se aktakuza \u00ebsht\u00eb ngritur n\u00eb harmoni me ligjin dhe e mb\u00ebshtetur n\u00eb prova t\u00eb artikulueshme, q\u00eb mb\u00ebshtesin dyshimin e bazuar mir\u00eb se Abdullahu ka kryer vepr\u00ebn penale t\u00eb vrasjes s\u00eb r\u00ebnd\u00eb n\u00eb bashk\u00ebkryerje.<\/p>\n\n\n\n

N\u00eb vendim t\u00eb Gjykat\u00ebs, thuhet se gjat\u00eb gjykimi t\u00eb \u00e7\u00ebshtjes do t\u00eb ket\u00eb n\u00eb konsiderat\u00eb faktet se t\u00eb akuzuarit tjer\u00eb p\u00ebr \u00e7far\u00eb vepra penale jan\u00eb d\u00ebnuar, t\u00eb akuzuarit tjer\u00eb a jan\u00eb shpallur fajtor\u00eb p\u00ebr nxitje-shtytje si dhe p\u00ebr elementin e bashk\u00ebkryerjes.<\/p>\n\n\n\n

Dhe se sipas Gjykat\u00ebs, pas shqyrtimit t\u00eb t\u00eb gjitha pretendimeve do t\u00eb nxjerr\u00eb vendim pasi q\u00eb tani p\u00ebr tani, shkalla e par\u00eb vler\u00ebson se akuza ka kaluar kriterin q\u00eb mb\u00ebshtesin dyshimin e bazuar mir\u00eb se Abdullahu ka kryer vepr\u00ebn penale, \u00e7ka e b\u00ebn t\u00eb domosdosh\u00ebm kalimin n\u00eb shqyrtim gjyq\u00ebsor.<\/p>\n\n\n\n

N\u00eb fund, thuhet se kund\u00ebr k\u00ebtij vendimi lejohet ankesa n\u00eb afat prej 10 dit\u00ebsh.<\/p>\n\n\n\n

\u00c7ka thot\u00eb aktakuza e PSRK-s\u00eb?<\/p>\n\n\n\n

Prokuroria Speciale e Republik\u00ebs s\u00eb Kosov\u00ebs (PSRK) m\u00eb 2 shtator 2024 ka ngritur aktakuz\u00eb n\u00eb Gjykat\u00ebn Themelore n\u00eb Prishtin\u00eb \u2013 Departamentin Special, kund\u00ebr t\u00eb pandehurit Ilir Abdullahu i njohur me nofk\u00ebn \u201cLiza\u201d.<\/p>\n\n\n\n

Abdullahu akuzohet se n\u00eb bashk\u00ebkryerje me tani t\u00eb d\u00ebnuarit Arben Berisha e Fitim Avdiu, si dhe t\u00eb pandehurit Enver Sekiraqa dhe Rrahim Abdullahu, si grup i organizuar nga Sekiraqa, t\u00eb shtyr\u00eb nga motivi i hakmarrjes s\u00eb paskrupullt, me dashje q\u00eb ta privojn\u00eb nga jeta tani t\u00eb ndjerin Triumf Riza, p\u00ebr arsye se tani i ndjeri, m\u00eb 24 dhjetor 2005 n\u00eb lokalin \u201cSwiss Casino\u201d n\u00eb Prishtin\u00eb, e kishte rrahur tani t\u00eb d\u00ebnuarin Sekiraqa, ku ky i fundit kishte qen\u00eb i shtrir\u00eb n\u00eb spital, se pas njoftimit me Adelina Ismailin, i nj\u00ebjti nuk ka lejuar q\u00eb t\u2019i jap\u00eb reket- t\u00eb holla si m\u00eb par\u00eb.<\/p>\n\n\n\n

M\u00eb tej, thuhet se p\u00ebr arrestimin dhe rrahjen e tij n\u00eb Ferizaj m\u00eb 22 maj 2006 nga ana e pjes\u00ebtar\u00ebve t\u00eb SHPK-s\u00eb, Sekiraqa kishte akuzuar tani t\u00eb ndjerin Triumf Riza se jan\u00eb t\u00eb shtyr\u00eb nga ana e tij, andaj jan\u00eb marr\u00eb vesh q\u00eb tani t\u00eb ndjerin ta privojn\u00eb nga jeta.<\/p>\n\n\n\n

N\u00eb aktakuz\u00eb thuhet se nj\u00eb koh\u00eb kan\u00eb p\u00ebrcjell\u00eb me vetura l\u00ebvizjet e Riz\u00ebs dhe m\u00eb 30 gusht 2007 derisa Arben Berisha, Enver Sekiraqa, Rrahim Abdullahu dhe Ilir Abdullahu kan\u00eb qen\u00eb n\u00eb lokalin \u201cSekiraqa\u201d, tani i d\u00ebnuari Avdiu, p\u00ebrmes telefonit t\u00eb tij, i ka d\u00ebrguar mesazh tani t\u00eb akuzuarit Abdullahu me p\u00ebrmbajtjen \u201cParking te Grandi, kojshija e kish dramen\u201c, duke aluduar n\u00eb Riz\u00ebn, i cili banes\u00ebn e kishte p\u00ebrball\u00eb lokalit \u201cSekiraqa\u201d, nd\u00ebrsa n\u00eb at\u00eb koh\u00eb ka qen\u00eb n\u00eb hotelin Grand.<\/p>\n\n\n\n

Gjithnj\u00eb sipas aktakuz\u00ebs, pasi e kishte marr\u00eb njoftimin tani i d\u00ebnuari Berisha dhe t\u00eb pandehurit Ilir Abdullahu e Rrahim Abdullahu, me vetur\u00eb kan\u00eb shkuar te lokali \u201cQuins\u201d, ku tani i d\u00ebnuari Berisha, i armatosur m\u00eb par\u00eb me pistolet\u00eb ka hyr\u00eb n\u00eb nj\u00eb lokal, nd\u00ebrsa i pandehuri Ilir dhe i pandehuri Rrahim kan\u00eb hyr\u00eb n\u00eb nj\u00eb lokal tjet\u00ebr, p\u00ebr t\u00eb pritur Riz\u00ebn, pasi ky i fundit pothuajse \u00e7do dit\u00eb ishte mysafir i atij lokali.<\/p>\n\n\n\n

M\u00eb pas, thuhet se i pandehuri Rrahim Abdullahu, p\u00ebrmes telefonit t\u00eb tij, i ka d\u00ebrguar mesazh tani t\u00eb d\u00ebnuarit Berisha, derisa ka qen\u00eb duke q\u00ebndruar ulur n\u00eb tarrac\u00ebn e nj\u00eb lokali af\u00ebr lokalit AMPM, me p\u00ebrmbajtjen \u201crri qatu hin mrena se mir je, ma von te thirri\u201c, pasi q\u00eb Riza ishte par\u00eb te lokali AMPM.<\/p>\n\n\n\n

N\u00eb aktakuz\u00eb thuhet se n\u00eb momentin kur Riza ka dal\u00eb nga lokali dhe ka qen\u00eb af\u00ebr automjetit t\u00eb tij, tani i d\u00ebnuari Berisha me vrap ka shkuar drejt tij dhe n\u00eb m\u00ebnyr\u00eb dinake, kur Riza nuk ka pritur kurrfar\u00eb sulmi, me shpin\u00eb t\u00eb kthyer nga ai, nga nj\u00eb distanc\u00eb prej 5 metrash, me pistolet\u00eb ka sht\u00ebn\u00eb 11 her\u00eb me tri rafale t\u00eb shkurtra, duke e goditur me 2 plumba n\u00eb shpin\u00eb, ku plumbat, p\u00ebr shkak t\u00eb veprimit dinamik, kan\u00eb dep\u00ebrtuar n\u00ebp\u00ebr aort\u00eb, zem\u00ebr dhe mushk\u00ebri, nga t\u00eb cilat l\u00ebndime ai ka vdekur, nd\u00ebrsa me nj\u00eb plumb \u00ebsht\u00eb goditur n\u00eb kofsh\u00ebn e k\u00ebmb\u00ebs s\u00eb djatht\u00eb.<\/p>\n\n\n\n

Me k\u00ebt\u00eb veprim, i akuzuari Ilir Abdullahu, n\u00eb bashk\u00ebkryerje me t\u00eb d\u00ebnuarit Arben Berisha e Fitim Avdiu, dhe t\u00eb pandehurit Enver Sekiraqa dhe Rrahim Abdullahu, akuzohen se kan\u00eb kryer vepr\u00ebn penale t\u00eb \u201cVrasjes s\u00eb r\u00ebnd\u00eb\u2019, nga neni 147, paragrafi 1, n\u00ebnparagraf\u00ebt 3 dhe 9, lidhur me nenin 23 t\u00eb Kodit t\u00eb P\u00ebrkohsh\u00ebm Penal t\u00eb Kosov\u00ebs.<\/p>\n\n\n\n

Ilir Abdullahu, i njohur me nofk\u00ebn \u201cLiza\u201d, u arrestua m\u00eb 16 korrik 2023, pasi p\u00ebr vite me radh\u00eb k\u00ebrkohej si i dyshuar p\u00ebr vrasjen e Triumf Riz\u00ebs.<\/p>\n\n\n\n

P\u00ebr Triumf Riz\u00ebn \u00ebsht\u00eb duke u gjykuar edhe Enver Sekiraqa, i akuzuar p\u00ebr nxitje t\u00eb vrasjes s\u00eb policit. Sekiraqa m\u00eb 3 maj 2024 u d\u00ebnua me 25 vjet burgim. I nj\u00ebjti gjendet n\u00eb arrati.<\/p>\n","protected":false},"excerpt":{"rendered":"
