T\u00eb m\u00ebrkur\u00ebn m\u00eb 21 qershor, n\u00eb seanc\u00ebn fillestare n\u00eb Gjykat\u00ebn Themelore n\u00eb Pej\u00eb, tre t\u00eb akuzuarit Kastriot, Kreshnik dhe Halil Mehmetaj, u deklaruan t\u00eb pafajsh\u00ebm lidhur me akuz\u00ebn p\u00ebr vrajsen e trefisht\u00eb m\u00eb 26 n\u00ebntor 2021 n\u00eb Gllogjan, ku kishin mbetur t\u00eb vdekur dy nx\u00ebn\u00ebs dhe shoferi i autobusit.<\/strong><\/p>\n\n\n\n

Deklarimin rreth faj\u00ebsis\u00eb, tre t\u00eb akuzuarit e b\u00ebn\u00eb pas leximit t\u00eb aktakuz\u00ebs nga prokurorja Sahide Gashi.<\/p>\n\n\n\n

Tre t\u00eb akuzuarit u deklaruan t\u00eb pafajsh\u00ebm lidhur me veprat penale \u201cVrasje e r\u00ebnd\u00eb\u201d, \u201cVrasje e r\u00ebnd\u00eb n\u00eb bashk\u00ebkryerje\u201d, \u201cShtytje n\u00eb vrasje t\u00eb r\u00ebnd\u00eb\u201d dhe Arm\u00ebmbajtje pa leje.<\/p>\n\n\n\n

N\u00eb dosjen e Prokuroris\u00eb t\u00eb siguruar nga \u201cBetimi p\u00ebr Drejt\u00ebsi\u201d, p\u00ebrshkruhet n\u00eb detaje se si ishte planifikuar vrasja nga t\u00eb akuzuarit si dhe motivet q\u00eb i shtyn\u00eb ata p\u00ebr kryerjen e k\u00ebtij akti.<\/p>\n\n\n\n

Sipas aktakuz\u00ebs, cak i vrasjes kishte qen\u00eb shoferi i autobusit, tani i ndjeri G.Gj. dhe se vrasje kishte ndodhur si hakmarrje, pasi familja Mhmetaj e kishin ka faj\u00ebsuar at\u00eb si shkaktar t\u00eb vet\u00ebvrasjes s\u00eb vajz\u00ebs s\u00eb tyre H.M.<\/p>\n\n\n\n

N\u00eb aktakuz\u00eb thuhet se, i pandehuri Halil, ishte betuar n\u00eb hakmarrja ndaj tani t\u00eb ndjerit G.Gj., si dhe me rastin e ceremonis\u00eb s\u00eb varrimit t\u00eb t\u00eb ndjer\u00ebs vajz\u00ebs s\u00eb tij n\u00eb arkivolin e saj vendos or\u00ebn e tij t\u00eb dor\u00ebs.<\/p>\n\n\n\n

Po ashtu n\u00eb aktakuz\u00eb p\u00ebrshkruhet se si t\u00eb akuzuarit e lartcekur n\u00eb  marr\u00ebveshje e bashk\u00ebveprim me nj\u00ebri tjetrin kishin studiuar terrenin me kujdes, duke u siguruar se nuk ka mbulueshm\u00ebri t\u00eb kamerave dhe sht\u00ebpi n\u00eb af\u00ebrsi, duke i z\u00ebn\u00eb priten autobusit q\u00eb vinte nga Gjakova n\u00eb drejtimin e Gllogjanit dhe pastaj nj\u00ebri nga ta kishte q\u00eblluar me arm\u00eb zjarri n\u00eb drejtim t\u00eb tij, duke i l\u00ebn\u00eb t\u00eb vdekur tre persona.<\/p>\n\n\n\n

Aktakuza e plot\u00eb e p\u00ebrpiluar nga Prokuroria Themelore e Pej\u00ebs:<\/strong><\/p>\n\n\n\n

Sipas aktakuz\u00ebs s\u00eb ngritur nga Prokuroria Themelore n\u00eb Pej\u00eb, me dat\u00eb 5 maj 2023,  ngarkon t\u00eb pandehurit Kastriot dhe Kreshnik Mehmetaj, se me dat\u00ebn 26 n\u00ebntor 2021, rreth or\u00ebs 18:58 minuta n\u00eb fshatin Gllogjan, Komuna e De\u00e7anit, sakt\u00ebsisht n\u00eb rrug\u00ebn \u201cIsmajl Haradinaj\u201d, t\u00eb shtyr\u00eb nga hakmarrja e paskrupullt, n\u00eb marr\u00ebveshje e bashk\u00ebveprim me nj\u00ebri tjetrin, privojn\u00eb nga jeta tre persona, dy prej tyre t\u00eb cil\u00ebt ishin f\u00ebmij\u00eb.<\/p>\n\n\n\n

N\u00eb aktakuz\u00eb thuhet se, pasi q\u00eb paraprakisht ata kishin studiuar terrenin me kujdes, duke u siguruar se nuk ka mbulueshm\u00ebri t\u00eb kamerave dhe sht\u00ebpi n\u00eb af\u00ebrsi dhe duke e ditur koh\u00ebn e sakt\u00eb t\u00eb arritjes s\u00eb autobusit \u201cErblini\u201d, nga Gjakova n\u00eb drejtimin e Gllogjanit n\u00eb turnin e fundit, t\u00eb cilin e drejtonte tani i ndjeri G., me nx\u00ebn\u00ebs dhe pasagjer\u00eb n\u00eb t\u00eb.<\/p>\n\n\n\n

Gjithnj\u00eb sipas aktakuz\u00ebs, i pandehuri Kastriot merr pushk\u00ebn automatike AK-47, prodhim shqiptar t\u00eb kalibrit 7.62x39mm dhe niset n\u00eb k\u00ebmb\u00eb deri tek vendi i ngjarjes, n\u00eb krahun e djatht\u00eb t\u00eb rrug\u00ebs dhe me t\u00eb v\u00ebrejtur dritat e autobusit n\u00eb fjal\u00eb, del n\u00eb mes t\u00eb rrug\u00ebs i kthyer m\u00eb shpin\u00eb kah autobusi q\u00eb po arrinte dhe me q\u00ebllim q\u00eb t\u00eb nj\u00ebjtin ta detyroj\u00eb t\u00eb ul\u00eb shpejt\u00ebsin\u00eb apo ndaloj, b\u00ebn\u00eb sikur \u00ebsht\u00eb i dehur dhe kur shoferi fillimisht e sinjalizon me drita t\u00eb gjata e pastaj edhe ul\u00eb shpejt\u00ebsin\u00eb i pandehuri Kastriot n\u00eb distanc\u00eb prej rreth 6 metrash kthehet n\u00eb drejtimin e autobusit dhe merr sh\u00ebnjest\u00ebr shoferin e autobusit tani t\u00eb ndjerin G.Gj. dhe e godet p\u00ebr vdekje, po ashtu godet p\u00ebr vdekje dhe L.H 17 vje\u00e7ar, dhe G.M 17 vje\u00e7are, si dhe i shkakton l\u00ebndime t\u00eb r\u00ebnda trupore F.T.<\/p>\n\n\n\n

Tutje thuhet se i pandehuri Kastriot ka rrezikuar jet\u00ebn e pasagjer\u00ebve tjer\u00eb: B.H., A.B., A.Z., B.M., dhe E.O, t\u00eb cil\u00ebt ishin n\u00eb ato momente prezent\u00eb n\u00eb autobus, dhe m\u00eb pas i nj\u00ebjti kalon nga krahu i majt\u00eb i autobusit, i cili kishte dal\u00eb jasht\u00eb rrug\u00ebs, dhe vazhdon n\u00eb fshatin Shaptej, ku n\u00eb mes t\u00eb rrug\u00ebs ishte duke e pritur me vetur\u00eb i pandehuri Kreshnik dhe merr rrug\u00ebn e kthimit pa u hetuar p\u00ebr n\u00eb sht\u00ebpi dhe pastaj shkat\u00ebrrojn\u00eb arm\u00ebn.<\/p>\n\n\n\n

Me tej n\u00eb aktakuz\u00eb thuhet se, kjo vrasje kishte ardhur si hakmarrje p\u00ebr shkak t\u00eb vet\u00ebvrasjes s\u00eb H.M. e cila kishte ndodhur me dat\u00ebn 14 qershor 2020, p\u00ebr t\u00eb cilin akt familja Mehmetaj e kan\u00eb faj\u00ebsuar tani t\u00eb ndjerin G.Gj.<\/p>\n\n\n\n

P\u00ebr k\u00ebto veprime prokuroria ata i ngarkon se si bashk\u00ebkryer\u00ebs kan\u00eb kryer vepr\u00ebn penale \u201cVrasje e r\u00ebnd\u00eb\u201d, nga neni 173, par.1, n\u00ebnpar. 1.1, 1.5, 1.8, e 1.11, lidhur me nenin 31 t\u00eb KPRK-s\u00eb.<\/p>\n\n\n\n

Tutje n\u00eb aktakuz\u00ebs, thuhet se i pandehuri Halil Mehmetaj, nga data 14 qershor 2020, gjer\u00eb me dat\u00ebn 26 n\u00ebntor 2021, n\u00eb fshatin Gllogjan, Komuna e De\u00e7anit, n\u00eb rrug\u00ebn \u201cIsmajl Haradinaj\u201d, ka shtyr\u00eb t\u00eb pandehurit Kastriot dhe Kreshnik Mehmetaj, n\u00eb vrasjen e tani t\u00eb ndjerit G.Gj., t\u00eb cilin para tyre e ka faj\u00ebsuar si shkaktar t\u00eb vet\u00ebvrasjes s\u00eb vajz\u00ebs s\u00eb tij H.M, ku p\u00ebr m\u00eb tep\u00ebr thuhet se ishte betuar n\u00eb hakmarrja, si dhe me rastin e ceremonis\u00eb s\u00eb varrimit t\u00eb t\u00eb ndjer\u00ebs n\u00eb arkivolin e saj vendos or\u00ebn e tij t\u00eb dor\u00ebs.<\/p>\n\n\n\n

Ai ngarkohet se ka kryer vepr\u00ebn penale \u201cShtytje n\u00eb vrasje t\u00eb r\u00ebnd\u00eb\u201d, nga neni 32, lidhur me nenin 173, par.1, n\u00ebnpar. 1.1, 1.5, 1.8, e 1.11, t\u00eb KPRK-s\u00eb.<\/p>\n\n\n\n

Gjithashtu aktakuza i ngarkon t\u00eb pandehurit Kastriot, Kreshnik dhe Halil Mehmetaj, q\u00eb n\u00eb koh\u00eb t\u00eb pacaktuar e gjer\u00eb me dat\u00ebn 11 dhjetor 2021, n\u00eb fshatin Gllogjan, Komuna e De\u00e7anit, n\u00eb sht\u00ebpin\u00eb e tyre n\u00eb kund\u00ebrshtim me nenin 5 par.1, t\u00eb Ligjit p\u00ebr Arm\u00eb, mbajn\u00eb n\u00eb pron\u00ebsi, posedim e kontroll municion, arm\u00eb e municion, ku n\u00eb rastin e kontrollit nga ana e policis\u00eb, k\u00ebta t\u00eb fundit gjejn\u00eb dhe sekuestrojn\u00eb, 156 fishek t\u00eb arm\u00ebs \u201cAK-47\u201d t\u00eb tipit \u201cKallashnikov\u00eb\u201d, nj\u00eb karikator i shkurt\u00eb i arm\u00ebs \u201cAK-47\u201d, \u201cKallashnikov\u00eb\u201d, 6 fishek t\u00eb arm\u00ebs s\u00eb gjuetis\u00eb 12mm, p\u00ebr t\u00eb cilat \u00ebsht\u00eb konstatuar se nuk kan\u00eb leje nga organet kompetente, si dhe 6 pajisje ushtarake.<\/p>\n\n\n\n
