Dhomat Speciale t\u00eb Kosov\u00ebs dhe Zyra e Prokurorit t\u00eb Specializuar, jan\u00eb krijuar q\u00eb n\u00eb vitin 2015 fal\u00eb nj\u00eb marr\u00ebveshje nd\u00ebrkomb\u00ebtare t\u00eb ratifikuar nga Kuvendi i Kosov\u00ebs, si nj\u00eb instrument hibrid i drejt\u00ebsis\u00eb me gjyqtar\u00eb, prokuror\u00eb dhe personel gjyq\u00ebsor nd\u00ebrkomb\u00ebtar, q\u00eb veprojn\u00eb n\u00eb kuad\u00ebr t\u00eb ligjit t\u00eb Kosov\u00ebs.<\/p>\n
Ata kan\u00eb juridiksion mbi krimet e luft\u00ebs, krimet kund\u00ebr njer\u00ebzimit dhe krimet e tjera sipas ligjit t\u00eb Kosov\u00ebs, t\u00eb ndodhura gjat\u00eb periudh\u00ebs 1 janar 1998- 31 dhjetor 2000. Tha\u00e7i dhe tre t\u00eb pandehurit e tjer\u00eb, jan\u00eb akuzuar secili me nga 6 akuza p\u00ebr krime kund\u00ebr njer\u00ebzimit (p\u00ebrfshir\u00eb persekutimin, tortur\u00ebn dhe vrasjen) dhe 4 akuza p\u00ebr krime lufte (p\u00ebrfshir\u00eb arrestimin dhe ndalimin e paligjsh\u00ebm dhe arbitrar, trajtimin mizor dhe vrasjen).<\/p>\n
Sipas aktakuz\u00ebs kund\u00ebr 4 ish-drejtuesve t\u00eb lart\u00eb t\u00eb U\u00c7K, ata ishin pjes\u00eb e nj\u00eb nd\u00ebrmarrjeje t\u00eb p\u00ebrbashk\u00ebt kriminale (NPK) dhe \u201cndanin q\u00ebllimin e p\u00ebrbashk\u00ebt p\u00ebr t\u00eb fituar dhe ushtruar kontroll mbi t\u00eb gjith\u00eb Kosov\u00ebn duke p\u00ebrfshir\u00eb frik\u00ebsimin e paligjsh\u00ebm, keqtrajtimin, kryerjen e dhun\u00ebs ndaj dhe largimin ata q\u00eb konsiderohen kund\u00ebrshtar\u00eb\u201d.<\/p>\n
K\u00ebta \u201ckund\u00ebrshtar\u00eb\u201d supozohet se p\u00ebrfshinin pakicat etnike (serb\u00eb, rom\u00eb dhe t\u00eb tjer\u00eb), si dhe shqiptar\u00eb etnik\u00eb q\u00eb nuk e p\u00ebrkrahnin U\u00c7K-n\u00eb. Aktakuza i referohet p\u00ebrgjegj\u00ebsis\u00eb s\u00eb t\u00eb pandehurve p\u00ebr shkak t\u00eb pozitave t\u00eb tyre t\u00eb larta drejtuese brenda U\u00c7K-s\u00eb, p\u00ebr krimet e kryera nga persona q\u00eb ishin n\u00ebn kontrollin e tyre.<\/p>\n
Tha\u00e7i \u00ebsht\u00eb deklaruar i pafajsh\u00ebm, dhe ka th\u00ebn\u00eb se pret t\u00eb lirohet nga t\u00eb gjitha akuzat. Edhe t\u00eb pandehurit e tjer\u00eb kan\u00eb mohuar \u00e7do faj n\u00eb raport me at\u00eb q\u00eb Krasniqi tha se ishte \u201cnd\u00ebrmarrje e p\u00ebrbashk\u00ebt \u00e7lirimtare dhe nd\u00ebrmarrje shtet-formuese\u201d.<\/p>\n
Selimi \u00ebsht\u00eb shprehur para gjykat\u00ebs se ai \u201cluftoi kund\u00ebr pushtuesit serb q\u00eb i solli vendit tim vet\u00ebm t\u00eb k\u00ebqija:vrasje, shp\u00ebrngulje, posht\u00ebrim dhe gjenocid\u201d. Edhe Veseli i ka mohuar akuzat. Pretendimet p\u00ebr trafikimin e organeve u b\u00ebn\u00eb p\u00ebr her\u00eb t\u00eb par\u00eb n\u00eb vitin 2008 dhe u hetuan nga Dick Marty, nj\u00eb politikan dhe ish-prokuror zviceran.<\/p>\n
Raporti i Martit p\u00ebr K\u00ebshillin e Evrop\u00ebs , i botuar n\u00eb janarin e vitit 2011 e sfidoi \u201cimazhin e shum\u00ebp\u00ebrfolur t\u00eb U\u00c7K-s\u00eb si nj\u00eb ushtri guerile q\u00eb luftoi trim\u00ebrisht p\u00ebr t\u00eb mbrojtur t\u00eb drejt\u00ebn e popullit t\u00eb saj p\u00ebr t\u00eb banuar n\u00eb territorin e Kosov\u00ebs\u201d.<\/p>\n
Ai pretendoi se gjeti prova t\u00eb nj\u00eb \u201cgrupi rob\u00ebrish t\u00eb luft\u00ebs\u201d, t\u00eb cil\u00ebt \u201cu d\u00ebrguan n\u00eb Shqip\u00ebrin\u00eb Qendrore p\u00ebr t\u2019u vrar\u00eb menj\u00ebher\u00eb, dhe me pas iu hoq\u00ebn veshkat n\u00eb nj\u00eb klinik\u00eb t\u00eb improvizuar operative\u201d. N\u00eb mesin e shqiptar\u00ebve t\u00eb Kosov\u00ebs ka nj\u00eb kund\u00ebrshtim t\u00eb fort\u00eb ndaj k\u00ebtij procesi.<\/p>\n
Mij\u00ebra protestues kan\u00eb dal\u00eb n\u00eb rrug\u00ebt e Prishtin\u00ebs , duke mbajtur pankarta me imazhet e 4 burrave dhe slogane si \u201cLiria ka nj\u00eb em\u00ebr\u201d dhe \u201cMos i barazoni viktimat me kriminel\u00ebt\u201d. Demonstrues jan\u00eb mbledhur edhe para sall\u00ebs s\u00eb gjyqit n\u00eb Hag\u00eb. Sipas nj\u00eb k\u00ebshilltari t\u00eb lart\u00eb ligjor n\u00eb Institutin e Kosov\u00ebs p\u00ebr Drejt\u00ebsi, \u00ebsht\u00eb e r\u00ebnd\u00ebsishme q\u00eb gjykimi t\u00eb kuptohet si nj\u00eb rast \u201ckund\u00ebr disa individ\u00ebve t\u00eb ish-U\u00c7K-s\u00eb, dhe jo gjykim kund\u00ebr U\u00c7K-s\u00eb apo vlerave q\u00eb p\u00ebrfaq\u00ebson populli i Kosov\u00ebs\u201d.<\/p>\n
Megjithat\u00eb, shum\u00eb shqiptar\u00eb t\u00eb Kosov\u00ebs nuk kan\u00eb gjasa ta b\u00ebjn\u00eb k\u00ebt\u00eb dallim. P\u00ebrvoja e m\u00ebparshme sugjeron se mund t\u00eb jet\u00eb e v\u00ebshtir\u00eb t\u00eb dalin d\u00ebshmitar\u00eb n\u00eb k\u00ebt\u00eb proces. Procesi i vitit 2008 kund\u00ebr 3 ish-an\u00ebtar\u00ebve t\u00eb tjer\u00eb t\u00eb U\u00c7K-s\u00eb (Ramush Haradinaj, Idriz Balaj dhe Lahi Brahimaj) raportoi \u201cv\u00ebshtir\u00ebsi t\u00eb konsiderueshme n\u00eb sigurimin e d\u00ebshmis\u00eb s\u00eb nj\u00eb numri t\u00eb madh d\u00ebshmitar\u00ebsh\u201d.<\/p>\n
