Gjykata Kushtetuese e ka publikuar sot Aktgjykimin e plot\u00eb, sipas t\u00eb cilit bien posht\u00eb ndryshimet e Ligji p\u00ebr K\u00ebshillin Prokurorial t\u00eb Kosov\u00ebs, t\u00eb hartuara nga Ministria e Drejt\u00ebsis\u00eb dhe i miratuar me shumic\u00eb votash n\u00eb Kuvend.<\/p>\n

Gjykata ka theksuar se ndryshimit t\u00eb Ligjit p\u00ebr K\u00ebshillin Prokurorial t\u00eb Kosov\u00ebs i kishte paraprir\u00eb procesi i Rishikimit Funksional t\u00eb Sektorit t\u00eb Sundimit t\u00eb Ligjit, q\u00eb ka rezultuar n\u00eb Strategjin\u00eb 5 p\u00ebr Sundimin e Ligjit 2021-2026, ku synohej \u201cngritja e llogaridh\u00ebnies s\u00eb sistemit gjyq\u00ebsor dhe prokurorial\u201d, nd\u00ebr t\u00eb tjera, p\u00ebrmes \u201czbatimit t\u00eb masave t\u00eb parapara, duke filluar me ndryshime ligjore n\u00eb p\u00ebrb\u00ebrjen e KGJK-s\u00eb dhe KPK-s\u00eb.<\/p>\n
N\u00eb Aktgjykim thuhet se parashtruesit e k\u00ebsaj k\u00ebrkese, q\u00eb jan\u00eb deputet\u00ebt e PDK-s\u00eb dhe t\u00eb LDK-s\u00eb, pretendojn\u00eb se nenet 13, 16, 18 dhe 20 t\u00eb Ligjit t\u00eb kontestuar nuk jan\u00eb n\u00eb p\u00ebrputhshm\u00ebri me nenet: 4 [Forma e Qeverisjes dhe Ndarja e Pushtetit], 24 [Barazia para Ligjit], 32 [E Drejta p\u00ebr Mjete Efektive], 45 [T\u00eb Drejtat Zgjedhore dhe t\u00eb Pjes\u00ebmarrjes], 54 [Mbrojtja Gjyq\u00ebsore e t\u00eb Drejtave], 109 [Prokurori i Shtetit] dhe 110 [K\u00ebshilli Prokurorial i Kosov\u00ebs] t\u00eb Kushtetut\u00ebs.<\/p>\n
Tutje thuhet se parashtruesit e k\u00ebsaj k\u00ebrkese, nd\u00ebr t\u00eb tjera, theksojn\u00eb se paragrafi 4 i nenit 110 t\u00eb Kushtetut\u00ebs, p\u00ebrcakton q\u00eb \u201cP\u00ebrb\u00ebrja e K\u00ebshillit Prokurorial t\u00eb Kosov\u00ebs, si dhe dispozitat p\u00ebr em\u00ebrimin, shkarkimin, mandatin, struktur\u00ebn organizative dhe rregullat e procedur\u00ebs, rregullohen me ligj\u201d. Sipas tyre, ky fakt ka mjaftuar q\u00eb Qeveria t\u00eb propozoj\u00eb dhe Kuvendi t\u00eb miratoj\u00eb Ligjin e kontestuar, i cili p\u00ebrve\u00e7 tjerash, ndryshon p\u00ebrb\u00ebrjen e KPK-s\u00eb dhe numrin e an\u00ebtar\u00ebve t\u00eb tij, nga tremb\u00ebdhjet\u00eb (13), sa ishte deri m\u00eb tani n\u00eb shtat\u00eb (7) sosh. Nd\u00ebrkaq, sipas parashtruesit t\u00eb k\u00ebrkes\u00ebs, arsyetimi i vet\u00ebm i k\u00ebtij ndryshimi substancial t\u00eb numrit t\u00eb an\u00ebtar\u00ebve t\u00eb KPK-s\u00eb, n\u00eb koncept-dokumentin q\u00eb i ka paraprir\u00eb atij ndryshimi, \u00ebsht\u00eb p\u00ebrmbledhur n\u00eb nj\u00eb fjali t\u00eb vetme dhe t\u00eb shkurt\u00ebr, p\u00ebrkat\u00ebsisht \u201cp\u00ebr q\u00ebllime t\u00eb efikasitetit t\u00eb pun\u00ebs s\u00eb KPK-s\u00eb\u201d.<\/p>\n

Nj\u00eb nga pikat e ligjit q\u00eb parashtruesit e kan\u00eb konstestuar, sipas Aktgjykimit, \u00ebsht\u00eb zgjedhja e dy an\u00ebtar\u00ebve jo-prokuror\u00eb t\u00eb KPK-s\u00eb me shumic\u00eb t\u00eb thjesht\u00eb t\u00eb votave n\u00eb Kuvend.<\/p>\n
\u201cP\u00ebrkitazi me zgjedhjen e dy (2) an\u00ebtar\u00ebve jo-prokuror\u00eb, parashtruesit e k\u00ebsaj k\u00ebrkese, pretendojn\u00eb se dispozitat e Ligjit t\u00eb kontestuar q\u00eb p\u00ebrcaktojn\u00eb zgjedhjen e 2 (dy) an\u00ebtar\u00ebve jo-prokuror\u00eb me shumic\u00eb t\u00eb thjesht\u00eb t\u00eb votave n\u00eb Kuvend, \u2018\u2026rrisin rrezikun q\u00eb an\u00ebtar\u00ebt e KPK-s\u00eb t\u00eb em\u00ebruar nga Kuvendi, t\u00eb jen\u00eb persona, q\u00eb potencialisht p\u00ebrfaq\u00ebsojn\u00eb politikat e shumic\u00ebs n\u00eb Kuvend dhe jo persona me autoritet dhe integritet q\u00eb marrin besimin gjith\u00ebp\u00ebrfshir\u00ebs t\u00eb p\u00ebrfaq\u00ebsuesve t\u00eb popullit\u2019\u201d.<\/p>\n
Sipas parashtruesve t\u00eb k\u00ebrkes\u00ebs, n\u00eb m\u00ebnyr\u00ebn se si \u00ebsht\u00eb p\u00ebrcaktuar zgjedhja e dy (2) an\u00ebtar\u00ebve jo-prokuror\u00eb nga Kuvendi, leht\u00ebsisht k\u00ebta an\u00ebtar\u00eb mund t\u00eb em\u00ebrohen me vet\u00ebm tridhjet\u00eb e nj\u00eb (31) vota t\u00eb deputet\u00ebve, q\u00eb si p\u00ebrfaq\u00ebsim \u00ebsht\u00eb minimal p\u00ebr em\u00ebrimin e personave n\u00eb k\u00ebt\u00eb institucion t\u00eb r\u00ebnd\u00ebsish\u00ebm kushtetues.<\/p>\n
\u201cN\u00eb k\u00ebt\u00eb kontekst, parashtruesit e k\u00ebsaj k\u00ebrkese vler\u00ebsojn\u00eb se zgjedhja e k\u00ebtyre an\u00ebtar\u00ebve t\u00eb KPK-s\u00eb, duhet t\u00eb b\u00ebhet me ligj, dhe me votat e s\u00eb paku gjasht\u00ebdhjet\u00eb e nj\u00eb (61) deputet\u00ebve ose me dy t\u00eb tretat (2\/3) e deputet\u00ebve q\u00eb votojn\u00eb n\u00eb procedur\u00ebn e zgjedhjes s\u00eb tyre nga Kuvendi. Kjo, sipas parashtruesve t\u00eb k\u00ebrkes\u00ebs do t\u00eb ishte nj\u00eb garanci p\u00ebr em\u00ebrimin e personaliteteve me reputacion dhe me integritet profesional, ashtu si\u00e7 e meriton ky institucion i r\u00ebnd\u00ebsish\u00ebm kushtetues q\u00eb p\u00ebrfshin nj\u00eb shtyll\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb. Pra, parashtruesit e k\u00ebsaj k\u00ebrkese, vler\u00ebsojn\u00eb se votimi me shumic\u00eb t\u00eb thjesht\u00eb, p\u00ebrkat\u00ebsisht nga shumica e deputet\u00ebve q\u00eb jan\u00eb t\u00eb pranish\u00ebm dhe q\u00eb votojn\u00eb, cenon pavar\u00ebsin\u00eb dhe integritetin e k\u00ebtij organi t\u00eb pavarur kushtetues, duke i dh\u00ebn\u00eb k\u00ebshtu secil\u00ebs shumic\u00eb parlamentare mund\u00ebsi t\u00eb madhe p\u00ebr ndikim dhe kontroll politik mbi an\u00ebtar\u00ebt jo-prokuror\u00eb n\u00eb KPK\u201d, thuhet n\u00eb shpjegimin e Gjykat\u00ebs Kushtetuese.<\/p>\n
N\u00eb Aktgjykim jan\u00eb p\u00ebrfshir\u00eb edhe komentet e dor\u00ebzuara nga K\u00ebshilli Prokurorial, ku, nd\u00ebr t\u00eb tjera thuhet, \u201cnd\u00ebrmarrja e veprimeve t\u00eb nj\u00ebanshme nga Ministria e Drejt\u00ebsis\u00eb p\u00ebr ta ndryshuar Ligjin nr. 06\/L-056 p\u00ebr K\u00ebshillin Prokurorial t\u00eb Kosov\u00ebs, pa filluar edhe me ndryshimet e tjera n\u00eb ligjet bazike t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb ashtu si\u00e7 \u00ebsht\u00eb parapar\u00eb me Strategjin\u00eb e Sundimit t\u00eb Ligjit ka qen\u00eb tendenc\u00eb p\u00ebr t\u00eb nd\u00ebrhyr\u00eb n\u00eb pavar\u00ebsin\u00eb e institucionit ton\u00eb\u201d.<\/p>\n
M\u00eb 19 korrik 2022, Ministria e Drejt\u00ebsis\u00eb i dor\u00ebzoi n\u00eb Gjykat\u00eb komentet e saj ndaj pretendimeve t\u00eb parashtruesve t\u00eb k\u00ebrkesave, ku fillimisht theksoi se k\u00ebrkesat e parashtruara jan\u00eb \u201cplot\u00ebsisht t\u00eb pabazuara\u201d. M\u00eb tej, lidhur me iniciativ\u00ebn p\u00ebr ndryshimin e Ligjit bazik, Ministria e Drejt\u00ebsis\u00eb, nd\u00ebr t\u00eb tjera, theksoi se nga Strategjia p\u00ebr Sundimin e Ligjit 2021-2026, rezulton n\u00eb t\u00eb gjetura p\u00ebrkitazi me funksionimin e KPK-s\u00eb, duke filluar nga: \u201c\u2026p\u00ebrb\u00ebrja, ku ka kritere kufizuese p\u00ebr an\u00ebtar\u00ebsimin e personave jasht\u00eb sistemit prokurorial dhe se ve\u00e7an\u00ebrisht numri i prokuror\u00ebve n\u00eb KPK \u00ebsht\u00eb mjaft i madh, duke n\u00ebnkuptuar se kriteret ligjore mund\u00ebsojn\u00eb p\u00ebrfaq\u00ebsim jo kualitativ dhe jo domosdoshm\u00ebrisht t\u00eb pavarur nga politika\u201d.<\/p>\n
Lidhur me ndryshimet n\u00eb p\u00ebrb\u00ebrje t\u00eb KPK-s\u00eb q\u00eb rezultojn\u00eb p\u00ebrmes Ligjit t\u00eb kontestuar, Avokati i Popullit, nd\u00ebr t\u00eb tjera, thekson se \u00ebsht\u00eb me r\u00ebnd\u00ebsi q\u00eb Gjykata t\u00eb vler\u00ebsoj\u00eb n\u00ebse t\u00eb nj\u00ebjtat jan\u00eb n\u00eb pajtim me dispozitat kushtetuese dhe n\u00ebse: \u201c\u2026cenohet pavar\u00ebsia e Avokatit t\u00eb Popullit sipas nenit 132 t\u00eb Kushtetut\u00ebs, po ashtu n\u00ebse cenohet ndarja e pushteteve,\u201d si dhe funksionimi i pavarur i KPK-s\u00eb, si\u00e7 garantohet edhe me nenin 110 t\u00eb Kushtetut\u00ebs.<\/p>\n
Sipas Avokatit t\u00eb Popullit, mund\u00ebsia q\u00eb Avokati i Popullit t\u00eb caktoj\u00eb nj\u00eb (1) an\u00ebtar t\u00eb KPK-s\u00eb \u201c\u2026eventualisht do t\u00eb mund t\u00eb shihej si cenim i pavar\u00ebsis\u00eb s\u00eb Avokatit t\u00eb Popullit, por edhe i asaj t\u00eb KPK-s\u00eb\u201d.<\/p>\n
Sipas Avokatit t\u00eb Popullit, kjo kompetenc\u00eb e re e cila parashihet me Ligjin e kontestuar, nuk buron as nga Kushtetuta dhe as nga Ligji p\u00ebr Avokatin e Popullit, dhe bazuar n\u00eb k\u00ebt\u00eb, Avokati i Popullit \u201c\u2026e vler\u00ebson si shum\u00eb t\u00eb r\u00ebnd\u00ebsishme q\u00eb Gjykata Kushtetuese t\u00eb vler\u00ebsoj kushtetutshm\u00ebrin\u00eb e p\u00ebrcaktimit t\u00eb kompetenc\u00ebs s\u00eb Avokatit t\u00eb Popullit n\u00eb caktimin e nj\u00eb an\u00ebtari t\u00eb KPK-s\u00eb, n\u00eb aspekt t\u00eb cenimit t\u00eb pavar\u00ebsis\u00eb s\u00eb tij\u201d.<\/p>\n
N\u00eb vler\u00ebsimin e saj, Gjykata Kushtetuese ka p\u00ebrfshir\u00eb dy Opinione, t\u00eb cilat i ka dh\u00ebn\u00eb Komisioni i Venecias p\u00ebr draftligjet e hartuara nga Ministria e Drejt\u00ebsis\u00eb.<\/p>\n
N\u00eb Aktgjykim thuhet se, sipas Opinionit t\u00eb par\u00eb t\u00eb Komisionit t\u00eb Venecias, \u201casnj\u00eb nga k\u00ebto modele nuk \u00ebsht\u00eb pa t\u00eb meta\u201d, sidoqoft\u00eb, (i) \u201c\u00e7far\u00ebdo modeli pluralist, \u00ebsht\u00eb m\u00eb i mir\u00eb se nj\u00eb model ku k\u00ebshillat prokurorial jan\u00eb t\u00eb dominuar nga nj\u00eb grup monolitik i an\u00ebtar\u00ebve prokuror\u00eb, t\u00eb n\u00ebnshtruar ndaj Kryeprokurorit t\u00eb Shtetit, ose nj\u00eb grup monolitik i t\u00eb em\u00ebruarve politik\u00eb q\u00eb i jan\u00eb besnik\u00eb shumic\u00ebs qeveris\u00ebse\u201d; dhe (ii) \u00ebsht\u00eb e r\u00ebnd\u00ebsishme q\u00eb p\u00ebrb\u00ebrja e KPK-s\u00eb t\u00eb jet\u00eb mjaftuesh\u00ebm \u201cpluraliste\u201d p\u00ebr t\u00eb siguruar q\u00eb prokuror\u00ebt t\u00eb mos mund t\u00eb qeverisin t\u00eb vet\u00ebm dhe n\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, q\u00eb an\u00ebtar\u00ebt jo-prokuror\u00eb, zgjedhja e t\u00eb cil\u00ebve \u00ebsht\u00eb b\u00ebr\u00eb me votat e shumic\u00ebs q\u00eb p\u00ebrfaq\u00ebsojn\u00eb shumic\u00ebn qeveris\u00ebse, \u201ct\u00eb mos mund t\u2019i mbivotojn\u00eb leht\u00eb ata\u201d.<\/p>\n
Pasi ka b\u00ebr\u00eb shqyrtimin e ankesave t\u00eb parashtruesve dhe komentet e marra nga t\u00eb gjitha pal\u00ebt e p\u00ebrfshira, Gjykata Kushtetuese ka vendosur t\u00eb pranoj\u00eb ankes\u00ebn e partive opozitare, duke konstatuar se pikat e kontestuara t\u00eb Ligjit nuk jan\u00eb n\u00eb p\u00ebrputhje me disa pika t\u00eb Kushtetut\u00ebs.
