Gjykata m\u00eb tej sqaron se, bazuar n\u00eb dokumentacionin e pranuar nga pal\u00ebt e interesuara, si rezultat i mosfaturimit t\u00eb energjis\u00eb elektrike p\u00ebr konsumator\u00ebt e energjis\u00eb elektrike n\u00eb kat\u00ebr (4) komunat e Republik\u00ebs s\u00eb Kosov\u00ebs, humbjet e energjis\u00eb elektrike jan\u00eb regjistruar \u201csi devijim i Kosov\u00ebs ndaj sistemit t\u00eb Evrop\u00ebs Kontinentale\u201d. Pas shfuqizimit t\u00eb Vendimit t\u00eb lartcekur t\u00eb ZREE-s\u00eb dhe deri n\u00eb prill t\u00eb vitit 2021, k\u00ebto humbje, p\u00ebrkat\u00ebsisht devijimet n\u00eb sistemin elektroenergjetik t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, jan\u00eb mbuluar nga Buxheti i Republik\u00ebs s\u00eb Kosov\u00ebs.<\/em><\/p>\n\n\n\n Me q\u00ebllim t\u00eb balancimit t\u00eb sistemit elekroenergjetik dhe mbulimit t\u00eb devijimeve p\u00ebrkat\u00ebse p\u00ebr periudh\u00ebn pasuese, si\u00e7 \u00ebsht\u00eb p\u00ebrcaktuar n\u00eb ligjet e aplikueshme t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs dhe posa\u00e7\u00ebrisht si rezultat i fillimit t\u00eb zbatimit t\u00eb Marr\u00ebveshjes s\u00eb Ky\u00e7jes me ENTSO-E, p\u00ebrkat\u00ebsisht Rrjetin Evropian t\u00eb Operator\u00ebve t\u00eb Sistemit t\u00eb Transmisionit p\u00ebr Energjin\u00eb Elektrike, si trup\u00eb e Grupit Regjional t\u00eb Evrop\u00ebs Kontinentale, Nd\u00ebrmarrja Publike KOSTT i \u00ebsht\u00eb drejtuar Kuvendit t\u00eb Kosov\u00ebs, p\u00ebrkat\u00ebsisht, Komisionit Funksional p\u00ebr Ekonomi, Industri, Nd\u00ebrmarr\u00ebsi dhe Tregti me k\u00ebrkes\u00ebn q\u00eb, nd\u00ebr tjerash, t\u00eb sigurohen mjetet financiare p\u00ebr mbulimin e humbjeve n\u00eb kat\u00ebr (4) komunat e Republik\u00ebs s\u00eb Kosov\u00ebs, p\u00ebr periudh\u00ebn prill \u2013 dhjetor 2021. N\u00eb k\u00ebt\u00eb aspekt, Gjykata, bazuar n\u00eb shkresat e dor\u00ebzuara nga KOSTT dhe ZREE, sqaron se m\u00eb 14 dhjetor 2020, ka filluar zbatimi i Marr\u00ebveshjes s\u00eb Ky\u00e7jes s\u00eb KOSTT-it me ENTSO-E. Marr\u00ebveshjes s\u00eb Ky\u00e7jes me ENTSO-E, i ka paraprir\u00eb ratifikimi n\u00eb Kuvend i Marr\u00ebveshjes Nd\u00ebrkomb\u00ebtare nd\u00ebrmjet Republik\u00ebs s\u00eb Kosov\u00ebs dhe Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, m\u00eb 30 mars 2017, e cila ka mund\u00ebsuar formimin e bllokut t\u00eb p\u00ebrbashk\u00ebt rregullues, q\u00eb njihet si Blloku Rregullues\u2013AK. Ky i fundit dhe Marr\u00ebveshja e lartcekur me ENTSO-E, i ka mund\u00ebsuar Republik\u00ebs s\u00eb Kosov\u00ebs (i) t\u00eb fitoj\u00eb pavar\u00ebsin\u00eb energjetike nga blloku rregullues Serbi, Mali i Zi, Maqedoni e Veriut; (ii) t\u00eb operoj\u00eb si zon\u00eb e pavarur rregulluese brenda Bllokut-AK, n\u00eb kuad\u00ebr t\u00eb zon\u00ebs sinkrone t\u00eb Evrop\u00ebs Kontinentale; dhe (iii) njohjen n\u00eb hartat energjetike t\u00eb Evrop\u00ebs, duke ia njohur sovranitetin e zon\u00ebs s\u00eb pavarur rregulluese n\u00eb sistemin elektroenergjetik t\u00eb Evrop\u00ebs Kontinentale. N\u00eb shk\u00ebmbim, institucionet e Kosov\u00ebs, jan\u00eb zotuar, nd\u00ebr tjerash, q\u00eb (i) t\u00eb garantojn\u00eb balancimin e sistemit elektroenergjetik n\u00eb kuad\u00ebr t\u00eb zon\u00ebs s\u00eb vet rregulluese duke adresuar p\u00ebr pasoj\u00eb humbjet\/devijimet p\u00ebrkat\u00ebse; nd\u00ebrsa, n\u00eb rast t\u00eb shkeljes s\u00eb detyrimeve q\u00eb dalin nga kjo Marr\u00ebveshje, Republika e Kosov\u00ebs do t\u00eb ballafaqohet: (i) me nd\u00ebshkim financiar; dhe (ii) rishqyrtim t\u00eb statusit t\u00eb KOSTT-it brenda ENTSO-E. Parashtruesit e k\u00ebrkes\u00ebs, n\u00eb fakt, nuk e kontestojn\u00eb detyrimin e Nd\u00ebrmarrjes Publike KOSTT p\u00ebr mbulimin e devijimeve t\u00eb energjis\u00eb elektrike n\u00eb k\u00ebto kat\u00ebr (4) komuna derisa t\u00eb nj\u00ebjtat t\u00eb futen n\u00eb sistemin e faturimit t\u00eb energjis\u00eb elektrike sipas ligjeve n\u00eb fuqi n\u00eb Republik\u00ebn e Kosov\u00ebs. Megjithat\u00eb, t\u00eb nj\u00ebjtit e kontestojn\u00eb procedur\u00ebn p\u00ebrmes t\u00eb cil\u00ebs \u00ebsht\u00eb nxjerr\u00eb Akti i kontestuar, duke pretenduar nj\u00ebkoh\u00ebsisht se mbulimi i k\u00ebtyre devijimeve n\u00eb energji elektrike n\u00eb komunat p\u00ebrkat\u00ebse, p\u00ebrb\u00ebn diskriminim n\u00eb kuptim t\u00eb nenit 24 t\u00eb Kushtetut\u00ebs dhe t\u00eb neneve p\u00ebrkat\u00ebse t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut. Komente dhe p\u00ebrgjigje n\u00eb Gjykat\u00eb kan\u00eb dor\u00ebzuar edhe (i) Grupi Parlamentar i L\u00ebvizjes Vet\u00ebvendosje; (ii) Ministria e Ekonomis\u00eb; (iii) ZREE; dhe (iv) KOSTT. P\u00ebrgjigje n\u00eb Gjykat\u00eb gjithashtu kan\u00eb dor\u00ebzuar edhe Komisionet p\u00ebrkat\u00ebse t\u00eb Kuvendit, p\u00ebrkat\u00ebsisht Komisioni p\u00ebr Legjislacion, Komisioni funksional p\u00ebr Ekonomi, Komisioni p\u00ebr Buxhet, Pun\u00eb dhe Transfere, si dhe Komisioni p\u00ebr Mbik\u00ebqyrjen e Financave Publike. N\u00eb thelb, komentet e dor\u00ebzuara n\u00eb Gjykat\u00eb pretendojn\u00eb q\u00eb Akti i kontestuar i Kuvendit (i) \u00ebsht\u00eb Rekomandim dhe jo vendim Kuvendi, dhe rrjedhimisht i nj\u00ebjti nuk mund t\u2019i n\u00ebnshtrohet kontrollit t\u00eb kushtetutshm\u00ebris\u00eb dhe p\u00ebr pasoj\u00eb, k\u00ebrkesa e parashtruesve t\u00eb k\u00ebrkes\u00ebs, duhet t\u00eb shpallet e papranueshme p\u00ebr shqyrtim n\u00eb merita nga Gjykata; (ii) Akti i kontestuar i Kuvendit \u00ebsht\u00eb nxjerr\u00eb duke u bazuar n\u00eb paragrafin 2 t\u00eb nenit 13 (Qeverisja korporative, kompetencat, raportimi) t\u00eb Ligjit nr. 05\/L-085 p\u00ebr Energjin\u00eb Elektrike, bazuar n\u00eb t\u00eb cilin Kuvendi \u00ebsht\u00eb aksionari i vet\u00ebm i Nd\u00ebrmarrjes Publike KOSTT; (iii) detyrimi i KOSTT-it p\u00ebr t\u00eb mbuluar devijimet e energjis\u00eb elektrike n\u00eb kat\u00ebr (4) komunat e Republik\u00ebs s\u00eb Kosov\u00ebs, \u00ebsht\u00eb i p\u00ebrcaktuar me nenin 16 (Detyrat dhe p\u00ebrgjegj\u00ebsit\u00eb e Operatorit t\u00eb Sistemit t\u00eb Transmetimit) t\u00eb Ligjit p\u00ebr Energji Elektrike dhe me nenin 5 (Kompensimi p\u00ebr Humbjet n\u00eb Veri t\u00eb Kosov\u00ebs) t\u00eb Licenc\u00ebs s\u00eb KOSTT-it, p\u00ebrkat\u00ebsisht [ZREE\/Li_15\/17, i 13 prillit 2017] dhe p\u00ebr m\u00eb tep\u00ebr, n\u00eb p\u00ebrputhshm\u00ebri me detyrimet e nd\u00ebrmarra p\u00ebr Marr\u00ebveshjen e Ky\u00e7jes n\u00eb ENTSO-E; dhe se (iv) Akti i kontestuar i Kuvendit \u00ebsht\u00eb n\u00eb interesin publik sepse nd\u00ebrlidhet me sovranitetin energjetik t\u00eb Kosov\u00ebs sipas obligimeve q\u00eb burojn\u00eb nga Marr\u00ebveshja e Ky\u00e7jes n\u00eb ENTSO-E.<\/em><\/p>\n\n\n\n (iii) Pranueshm\u00ebria e k\u00ebrkes\u00ebs: N\u00eb vler\u00ebsimin e kushtetutshm\u00ebris\u00eb s\u00eb Aktit t\u00eb kontestuar t\u00eb Kuvendit, Gjykata fillimisht vler\u00ebsoi pretendimet e parashtruesve t\u00eb k\u00ebrkes\u00ebs dhe p\u00ebrgjigjet p\u00ebrkat\u00ebse t\u00eb pal\u00ebve t\u00eb interesuara, p\u00ebrkitazi me natyr\u00ebn e Aktit t\u00eb kontestuar. Gjykata n\u00eb k\u00ebt\u00eb aspekt konstatoi se, Akti i kontestuar i Kuvendit hyn n\u00eb fush\u00ebveprimin e \u201cvendimit t\u00eb Kuvendit\u201d, si\u00e7 p\u00ebrcaktohet me paragrafin 5 t\u00eb nenit 113 t\u00eb Kushtetut\u00ebs dhe rrjedhimisht k\u00ebrkesa \u00ebsht\u00eb e pranueshme p\u00ebr shqyrtim n\u00eb merita. Kjo, nd\u00ebr tjerash, dhe bazuar edhe n\u00eb sqarimet e dh\u00ebna n\u00eb Aktgjykim, sepse (i) vendimi p\u00ebrkat\u00ebs i Kuvendit \u00ebsht\u00eb miratuar me shumic\u00eb votash t\u00eb deputet\u00ebve t\u00eb Kuvendit; dhe (ii) ka efekte juridike p\u00ebr KOSTT-in dhe Qeverin\u00eb e Republik\u00ebs s\u00eb Kosov\u00ebs. P\u00ebr m\u00eb tep\u00ebr, Gjykata n\u00ebp\u00ebrmjet praktik\u00ebs s\u00eb saj t\u00eb konsoliduar gjyq\u00ebsore tashm\u00eb, ka theksuar se vendimmarrja e autoriteteve publike do t\u00eb mbetej jasht\u00eb kontrollit kushtetues, n\u00ebse Gjykata do t\u00eb bazohej vet\u00ebm n\u00eb em\u00ebrtimin formal\/terminologjin\u00eb t\u00eb cil\u00ebn t\u00eb nj\u00ebjtat kan\u00eb vendosur t\u2019ia p\u00ebrcaktojn\u00eb aktit p\u00ebrkat\u00ebs. N\u00eb shqyrtimin e meritave t\u00eb \u00e7\u00ebshtjes, Gjykata u fokusua n\u00eb vler\u00ebsimin e kushtetutshm\u00ebris\u00eb t\u00eb procedur\u00ebs dhe t\u00eb p\u00ebrmbajtjes s\u00eb Aktit t\u00eb kontestuar t\u00eb Kuvendit, p\u00ebrkat\u00ebsisht n\u00ebse me nxjerrjen e k\u00ebtij Akti, Kuvendi (i) ka vepruar n\u00eb (pa)pajtueshm\u00ebri me kompetenc\u00ebn e tij p\u00ebr vendimmarrje t\u00eb p\u00ebrcaktuar me Kushtetut\u00eb dhe me ligj; dhe (ii) ka kufizuar t\u00eb drejtat dhe lirit\u00eb themelore t\u00eb konsumator\u00ebve t\u00eb energjis\u00eb elektrike q\u00eb nuk jetojn\u00eb n\u00eb kat\u00ebr (4) komunat e Republik\u00ebs s\u00eb Kosov\u00ebs, n\u00eb kund\u00ebrshtim me nenin 24 t\u00eb Kushtetut\u00ebs n\u00eb lidhje me nenin 14 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut dhe nenin 1 t\u00eb Protokollit nr. 12 t\u00eb k\u00ebsaj Konvente.<\/em><\/p>\n\n\n\n Kushtetutshm\u00ebria e procedures: Sa i p\u00ebrket vler\u00ebsimit t\u00eb kushtetutshm\u00ebris\u00eb s\u00eb procedur\u00ebs s\u00eb ndjekur, Gjykata fillimisht shtjelloi (i) kompetencat dhe p\u00ebrgjegj\u00ebsit\u00eb e Nd\u00ebrmarrjes Publike KOSTT; (ii) detyrimin e KOSTT-it p\u00ebr balancimin e sistemit t\u00eb energjis\u00eb dhe mbulimin e devijimeve t\u00eb energjis\u00eb elektrike; (iii) t\u00eb drejtat dhe detyrimet e KOSTT-it n\u00eb raport me Marr\u00ebveshjen e Ky\u00e7jes me ENTSO-E; (iv) kompetencat kushtetuese dhe ligjore t\u00eb Kuvendit p\u00ebr miratimin e Ligjit p\u00ebr Buxhet dhe p\u00ebrgjegj\u00ebsit\u00eb n\u00eb lidhje me financat publike; dhe (v) procedur\u00ebn e ndjekur n\u00eb Kuvend dhe kompetenc\u00ebn p\u00ebrkat\u00ebse p\u00ebr nxjerrjen e Aktit t\u00eb kontestuar, dhe Gjykata konstatoi se, procedura e ndjekur n\u00eb nxjerrjen e Aktit t\u00eb kontestuar t\u00eb Kuvendit, \u00ebsht\u00eb n\u00eb pajtueshm\u00ebri me nenin 65 t\u00eb Kushtetut\u00ebs. N\u00eb mb\u00ebshtetje t\u00eb k\u00ebtij konstatimi, Gjykata theksoi se (i) bazuar n\u00eb paragrafin 1 t\u00eb nenit 65 t\u00eb Kushtetut\u00ebs, Kuvendi miraton ligje, rezoluta dhe akte; (ii) bazuar n\u00eb paragrafin 14 t\u00eb nenit 65 t\u00eb Kushtetut\u00ebs, Kuvendi vendos \u201cp\u00ebr \u00e7\u00ebshtjet me interes t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb p\u00ebrcaktuara me ligj\u201d; (iii) n\u00eb ushtrimin e kompetencave t\u00eb tij t\u00eb p\u00ebrcaktuara me ligj, p\u00ebrkat\u00ebsisht bazuar n\u00eb paragrafin 2 t\u00eb nenit 13 t\u00eb Ligjit p\u00ebr Energjin\u00eb Elektrike, Kuvendi i Republik\u00ebs s\u00eb Kosov\u00ebs ushtron t\u00eb drejtat e aksionarit t\u00eb KOSTT; (iv) p\u00ebr m\u00eb tep\u00ebr, bazuar n\u00eb paragrafin 1 t\u00eb nenit 13 t\u00eb Ligjit p\u00ebr Energjin\u00eb Elektrike, KOSTT funksionon si Nd\u00ebrmarrje Publike n\u00eb pajtim me Ligjin nr.03\/L-087 p\u00ebr Nd\u00ebrmarrjet Publike dhe legjislacionin p\u00ebrkat\u00ebs n\u00eb fuqi; (v) bazuar n\u00eb nenin 4 (Aksionet) t\u00eb Ligjit nr. 03\/L-087 p\u00ebr Nd\u00ebrmarrjet Publike, k\u00ebto t\u00eb fundit organizohen si shoq\u00ebri aksionare, n\u00eb p\u00ebrputhje me ligjin n\u00eb fuqi p\u00ebr shoq\u00ebrit\u00eb tregtare; dhe se (vi) bazuar n\u00eb nenin 151 (Procedura p\u00ebr Autorizimin e Dividend\u00ebve) t\u00eb Ligjit nr. 06\/L-016 p\u00ebr Shoq\u00ebrit\u00eb Tregtare, nd\u00ebr tjerash, vendimi p\u00ebr autorizimin dhe pagimin e dividend\u00ebve mund t\u00eb b\u00ebhet nga aksionar\u00ebt. Bazuar n\u00eb si m\u00eb sip\u00ebr, Gjykata sqaroi se n\u00eb nxjerrjen e Aktit t\u00eb kontestuar, Kuvendi, nd\u00ebr tjerash, kishte autorizuar KOSTT-in t\u00eb mbuloj\u00eb devijimet e energjis\u00eb elektrike n\u00eb kat\u00ebr (4) komuna \u201cduke shfryt\u00ebzuar t\u00eb hyrat nga buxheti vetanak, mjete k\u00ebto t\u00eb cilat do t\u00eb kompensohen nga dividenda apo ndonj\u00eb mekaniz\u00ebm tjet\u00ebr i mundsh\u00ebm\u201d dhe se k\u00ebt\u00eb vendim, e kishte nxjerr\u00eb (i) duke ushtruar kompetenc\u00ebn e tij si aksionar i Nd\u00ebrmarrjes Publike KOSTT; dhe (ii) n\u00eb ushtrimin e kompetenc\u00ebs s\u00eb aksionarit, kishte vendosur p\u00ebrkitazi me dividend\u00ebn e KOSTT-it; nd\u00ebrsa, ushtrimi i k\u00ebsaj kompetence (i) nuk nd\u00ebrlidhet me kompetenc\u00ebn e Kuvendit t\u00eb p\u00ebrcaktuar n\u00eb paragrafin 5 t\u00eb nenit 65 t\u00eb Kushtetut\u00ebs p\u00ebrkitazi me buxhetin e Republik\u00ebs s\u00eb Kosov\u00ebs, si\u00e7 \u00ebsht\u00eb sqaruar para Gjykat\u00ebs edhe nga Komisionet p\u00ebrkat\u00ebse t\u00eb Kuvendit, p\u00ebrkat\u00ebsisht Komisionit p\u00ebr Buxhet, Pun\u00eb dhe Transfere dhe Komisionit p\u00ebr Mbik\u00ebqyrjen e Financave Publike; por (ii) bazohet n\u00eb ushtrimin e kompetencave t\u00eb Kuvendit t\u00eb p\u00ebrcaktuara n\u00eb paragraf\u00ebt 1 dhe 14 t\u00eb nenit 65 t\u00eb Kushtetut\u00ebs, sipas t\u00eb cilave Kuvendi mund t\u00eb nxjerr\u00eb akte lidhur me \u00e7\u00ebshtjet me interes t\u00eb p\u00ebrgjithsh\u00ebm t\u00eb p\u00ebrcaktuara me ligj.<\/em><\/p>\n\n\n\n Kushtetutshm\u00ebria e p\u00ebrmbajtjes: Sa i p\u00ebrket vler\u00ebsimit t\u00eb kushtetutshm\u00ebris\u00eb s\u00eb p\u00ebrmbajtjes s\u00eb Aktit t\u00eb kontestuar t\u00eb Kuvendit, Gjykata fillimisht shtjelloi parimet e p\u00ebrgjithshme p\u00ebrkitazi me garancit\u00eb e nenit 24 t\u00eb Kushtetut\u00ebs, nenit 14 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut dhe nenit 1 t\u00eb Protokollit nr. 12 t\u00eb k\u00ebsaj Konvente, duke theksuar se neni 24 i Kushtetut\u00ebs n\u00eb lidhje me nenin 1 t\u00eb Protokollit nr. 12 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, shtrijn\u00eb mbrojtjen kund\u00ebr diskriminimit edhe lidhur me \u00e7do t\u00eb drejt\u00eb t\u00eb p\u00ebrcaktuar me ligj. M\u00eb pas, Gjykata shtjelloi parimet e p\u00ebrgjithshme bazuar n\u00eb praktik\u00ebn e saj gjyq\u00ebsore dhe asaj t\u00eb Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat Njeriut, duke sqaruar se p\u00ebr t\u00eb konstatuar n\u00ebse nj\u00eb akt mund t\u00eb ket\u00eb rezultuar n\u00eb diskriminim n\u00eb kund\u00ebrshtim me garancit\u00eb e k\u00ebtyre neneve, s\u00eb pari duhet t\u00eb vler\u00ebsohet n\u00ebse akti p\u00ebrkat\u00ebs ka trajtuar n\u00eb m\u00ebnyr\u00eb t\u00eb ndryshme \u201cpersona n\u00eb situata analoge ose relativisht t\u00eb ngjashme\u201d, dhe n\u00ebse ky \u00ebsht\u00eb rasti, t\u00eb vler\u00ebsoj\u00eb n\u00ebse ky dallim n\u00eb trajtim (a) \u00ebsht\u00eb i p\u00ebrcaktuar me ligj; (b) ndjek nj\u00eb q\u00ebllim legjitim; dhe (c) \u00ebsht\u00eb proporcional, p\u00ebrkat\u00ebsisht n\u00ebse ekziston nj\u00eb marr\u00ebdh\u00ebnie e proporcionalitetit nd\u00ebrmjet kufizimit t\u00eb s\u00eb drejt\u00ebs dhe q\u00ebllimit q\u00eb synohet t\u00eb arrihet. N\u00eb kontekstin e lartcekur, Gjykata fillimisht konstatoi se n\u00eb rrethanat e rastit konkret, n\u00eb kuptim t\u00eb dispozitave ligjore p\u00ebrkitazi me konsumator\u00ebt e energjis\u00eb elektrike n\u00eb Republik\u00ebn e Kosov\u00ebs, konsumator\u00ebt n\u00eb t\u00eb gjitha komunat jan\u00eb n\u00eb \u201csituata analoge ose relativisht t\u00eb ngjashme\u201d. Nd\u00ebrsa, n\u00eb vler\u00ebsimin e dallimit n\u00eb trajtim, Gjykata theksoi se, si rezultat i mosfaturimit\/mospages\u00ebs s\u00eb energjis\u00eb elektrike p\u00ebr konsumator\u00ebt e energjis\u00eb elektrike n\u00eb kat\u00ebr (4) komunat e Republik\u00ebs s\u00eb Kosov\u00ebs, konsumi i energjis\u00eb elektrike n\u00eb k\u00ebto kat\u00ebr (4) komuna, \u00ebsht\u00eb regjistruar si devijim. P\u00ebr k\u00ebt\u00eb q\u00ebllim, KOSTT-i ka k\u00ebrkuar ndarjen e mjeteve buxhetore me q\u00ebllim t\u00eb prokurimit t\u00eb energjis\u00eb elektrike p\u00ebr mbulimin e devijimeve n\u00eb kat\u00ebr (4) komunat e Republik\u00ebs s\u00eb Kosov\u00ebs. P\u00ebr m\u00eb tep\u00ebr, bazuar n\u00eb Aktin e kontestuar t\u00eb Kuvendit, rezulton q\u00eb si pasoj\u00eb e autorizimit dh\u00ebn\u00eb KOSTT-it nga Kuvendi p\u00ebr mbulimin e devijimeve n\u00eb energjin\u00eb elektrike p\u00ebr shkak t\u00eb mosfaturimit\/mospages\u00ebs s\u00eb energjis\u00eb elektrike p\u00ebr konsumator\u00ebt e kat\u00ebr (4) komunave t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs deri n\u00eb fillimin e zbatimit t\u00eb procesit t\u00eb futjes n\u00eb sistemin e faturimit t\u00eb konsumit t\u00eb energjis\u00eb elektrike p\u00ebr konsumator\u00ebt e k\u00ebtyre kat\u00ebr (4) komunave, k\u00ebta t\u00eb fundit g\u00ebzojn\u00eb nj\u00eb trajtim ndryshe nga konsumator\u00ebt e komunave t\u00eb tjera t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs.<\/em><\/p>\n\n\n\n P\u00ebr pasoj\u00eb, Gjykata konstatoi se, Akti i kontestuar i Kuvendit rezulton n\u00eb dallim n\u00eb trajtim n\u00eb mes konsumator\u00ebve q\u00eb jetojn\u00eb dhe q\u00eb nuk jetojn\u00eb n\u00eb kat\u00ebr (4) komunat e Republik\u00ebs s\u00eb Kosov\u00ebs. Gjykata megjithat\u00eb theksoi se, dallimi n\u00eb trajtim n\u00eb mes personave n\u00eb \u201csituata analoge ose relativisht t\u00eb ngjashme\u201d, bazuar n\u00eb praktik\u00ebn gjyq\u00ebsore t\u00eb Gjykat\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, rezulton n\u00eb diskriminim n\u00eb kund\u00ebrshtim me garancit\u00eb e nenit 24 t\u00eb Kushtetut\u00ebs n\u00eb lidhje me nenin 1 t\u00eb Protokollit nr. 12 t\u00eb Konvent\u00ebs Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, vet\u00ebm n\u00ebse akti p\u00ebrkat\u00ebs i autoritetit publik nuk ng\u00ebrthen \u201cnj\u00eb justifikim objektiv dhe t\u00eb arsyesh\u00ebm\u201d. Prandaj, vler\u00ebsimi n\u00ebse dallimi n\u00eb trajtim \u00ebsht\u00eb (a) p\u00ebrcaktuar n\u00eb ligj; (b) ndjek nj\u00eb q\u00ebllim legjitim; dhe (c) \u00ebsht\u00eb proporcional, \u00ebsht\u00eb i nevojsh\u00ebm. S\u00eb pari, Gjykata konstatoi q\u00eb dallimet n\u00eb trajtim t\u00eb konsumator\u00ebve t\u00eb energjis\u00eb elektrike n\u00eb kat\u00ebr (4) komunat e Republik\u00ebs s\u00eb Kosov\u00ebs, jan\u00eb t\u00eb \u201cp\u00ebrcaktuara n\u00eb ligj\u201d.
