N\u00eb seanc\u00ebn e s\u00eb enjtes, n\u00eb fjal\u00ebn e tij p\u00ebrfundimtare, ai tha se prokuroria ka d\u00ebshtuar n\u00eb hetimin e plot\u00eb t\u00eb k\u00ebsaj vrasjeje, raporton \u201cBetimi p\u00ebr Drejt\u00ebsi\u201d.<\/p>\n
Sipas avokatit Kastrati, p\u00ebr k\u00ebt\u00eb vrasje duhet t\u00eb akuzohet edhe personi i tret\u00eb q\u00eb ka qen\u00eb bashk\u00eb me t\u00eb akuzuarat dit\u00ebn kritike, si dhe e se Granit Alushani \u00ebsht\u00eb dashur t\u00eb akuzohet p\u00ebr ndihm\u00eb n\u00eb kryerjen e vrasjes. Kastrati tha se sipas t\u00eb akuzuar\u00ebs Nafije Rrafshi, i lartp\u00ebrmenduri e ka d\u00ebrguar at\u00eb q\u00eb ta blej\u00eb arm\u00ebn.<\/p>\n
K\u00ebto pretendime t\u00eb avokatit Kastrati i ka kund\u00ebrshtuar e akuzuara Rrafshi, e cila tha se k\u00ebt\u00eb vrasje e ka kryer e vetme ajo.<\/p>\n
\u201cN\u00eb k\u00ebt\u00eb rast nuk \u00ebsht\u00eb i p\u00ebrfshim\u00eb asnj\u00eb person dhe nuk e ka bo k\u00ebt\u00eb vep\u00ebr asnj\u00eb person tjet\u00ebr p\u00ebrpos meje. Jan\u00eb arrestu persona t\u00eb pafajsh\u00ebm, s\u00eb pari djali jem Fatoni i cili nuk ka qen\u00eb n\u00eb Kosov\u00eb, pastaj vajza Behare Nura e ish-dh\u00ebndri im. Nuk e kam bo n\u00eb m\u00ebnyr\u00eb dinake un\u00eb k\u00ebt\u00eb vrasje por ashiqare, pasi q\u00eb kam qen\u00eb e k\u00ebrc\u00ebnuar me vrasje nga i ndjeri.\u201d, tha e akuzuara Rrafshi.<\/p>\n
Ajo tutje shtoi se k\u00ebt\u00eb vrasje nuk e ka e ka b\u00ebr\u00eb as me dashje, as me vet\u00ebdije, e as me paramendim.<\/p>\n
Nd\u00ebrsa, mbrojt\u00ebsi i t\u00eb akuzuar\u00ebs Rrafshi, avokati Nexhmedin Gashi tha se nuk ka ekzistuar dashja p\u00ebr t\u2019u kryer kjo vrasje dhe se e akuzuara e ka zmbrapsur sulmin e at\u00eb\u00e7astsh\u00ebm.<\/p>\n
E mbrojt\u00ebsi i t\u00eb akuzuar\u00ebs Nura, avokati Prenk Pepaj k\u00ebrkoi nga gjykata q\u00eb e mbrojtura e tij t\u00eb lirohet nga aktakuza n\u00eb munges\u00eb t\u00eb provave.<\/p>\n
Ai tha se prokurori aktakuz\u00ebn ku e akuzon Behare Nur\u00ebn dhe Nafije Rrafshin p\u00ebr vrasjen n\u00eb bashk\u00ebkryerje e ka b\u00ebr\u00eb n\u00eb kund\u00ebrshtim me dispozitat ligjore.<\/p>\n
\u201cProkuroria nuk i ka p\u00ebrshkruar veprimet e secil\u00ebs ve\u00e7 e ve\u00e7 e q\u00eb \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me dispozitat e Kodit t\u00eb Procedur\u00ebs Penale, meqen\u00ebse \u00e7do veprim i bashk\u00ebkryerjes duhet t\u00eb p\u00ebrshkruhet n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb plot\u00ebsohen elementet e figur\u00ebs s\u00eb vepr\u00ebs penale n\u00eb bashk\u00ebkryerje\u201d, tha avokati Pepaj.<\/p>\n
E akuzuara Behare Nura tha se padrejt\u00ebsisht \u00ebsht\u00eb duke u mbajtur tash e 18 muaj n\u00eb paraburgim dhe se ajo nuk e di se si ka ndodhur vrasja pasi q\u00eb ka qen\u00eb n\u00eb vetur\u00eb.<\/p>\n
Kurse, prokurori Ali Uka, i cili fjal\u00ebn e tij p\u00ebrfundimtare e dor\u00ebzoi n\u00eb form\u00eb t\u00eb shkruar, tha se \u00ebsht\u00eb v\u00ebrtetuar pa m\u00ebdyshje nga provat e administruara se dy t\u00eb akuzuarat i kan\u00eb kryer veprat penale me t\u00eb cilat ngarkohen.<\/p>\n
Ai i propozoi gjykat\u00ebs q\u00eb t\u00eb nj\u00ebjtat t\u2019i shpall\u00eb fajtore dhe t\u2019i d\u00ebnoj\u00eb sipas ligjit, duke k\u00ebrkuar q\u00eb edhe i akuzuari tjet\u00ebr n\u00eb k\u00ebt\u00eb rast, Granit Alushani t\u00eb shpallet fajtor p\u00ebr arm\u00ebmbajtje pa leje.<\/p>\n
Kryetari i trupit gjykues, gjykat\u00ebsi Shaqir Zika seanc\u00ebn p\u00ebr shpalljen e aktgjykimit e ka caktuar q\u00eb t\u00eb mbahet m\u00eb 13 korrik 2021, n\u00eb ora 14:30.<\/p>\n
Fillimisht lidhur me k\u00ebt\u00eb vrasje akuzohej vet\u00ebm Nafije Rrafshi, mir\u00ebpo prokurori Ali Uka, kishte k\u00ebrkuar q\u00eb gjykimi t\u00eb nd\u00ebrpritet pasi q\u00eb kishte marr\u00eb aktvendim p\u00ebr zgjerim t\u00eb hetimeve dhe ndaj dy t\u00eb pandehurve tjer\u00eb, me dyshimin e bazuar se n\u00eb bashk\u00ebkryerje me t\u00eb akuzuar\u00ebn Nafije Rrafshin e kan\u00eb kryer vepr\u00ebn penale t\u00eb vrasjes.<\/p>\n
K\u00ebto hetime kan\u00eb rezultuar me ngritjen e nj\u00eb aktakuze edhe ndaj Behare Nur\u00ebs, me dyshimin se e nj\u00ebjta s\u00eb bashku me Nafije Rrafshin kan\u00eb kryer vepr\u00ebn penale t\u00eb vrasjes, nd\u00ebrsa i akuzuari Granit Alushani po ngarkohet vet\u00ebm me vepr\u00ebn penale t\u00eb arm\u00ebmbajtjes pa leje.<\/p>\n
Sipas aktakuz\u00ebs s\u00eb Prokuroris\u00eb Themelore n\u00eb Gjakov\u00eb, Behare Nura po akuzohet se m\u00eb 4 gusht 2018, rreth or\u00ebs 9:30, n\u00eb rrug\u00ebn \u201cHabib Zogaj\u201d n\u00eb fshatin Lladrovc t\u00eb Malishev\u00ebs, me dashje n\u00eb bashk\u00ebkryerje me t\u00eb akuzuar\u00ebn Nafije Rrafshi, p\u00ebr motive t\u00eb panjohura kan\u00eb privuar nga jeta tani t\u00eb ndjerin Sefer Berisha, i mosh\u00ebs 57 vje\u00e7.<\/p>\n
Tutje sipas aktakuz\u00ebs, t\u00eb akuzuarit pasi dalin nga automjeti i tyre dhe i afrohen automjetit t\u00eb tani t\u00eb ndjerit i cili kishte dal\u00eb nga rruga dhe ishte ndalur n\u00eb nj\u00eb breg n\u00eb af\u00ebrsi t\u00eb pyllit, nga nj\u00eb larg\u00ebsi p\u00ebr momentin t\u00eb panjohur nj\u00ebra prej t\u00eb akuzuarave me revolen e tipit TT kalib\u00ebr 7.62mm ka sht\u00ebn\u00eb nga jasht\u00eb automjetit n\u00eb drejtim t\u00eb ul\u00ebses ku ishte i ulur i ndjeri, ashtu q\u00eb me nj\u00ebr\u00ebn prej t\u00eb sht\u00ebnave e q\u00ebllon at\u00eb n\u00eb an\u00ebn e majt\u00eb t\u00eb qaf\u00ebs nd\u00ebrsa me t\u00eb sht\u00ebn\u00ebn tjet\u00ebr n\u00eb kok\u00eb mbi veshin e djatht\u00eb.<\/p>\n
P\u00ebr k\u00ebt\u00eb, ato po akuzohen se kan\u00eb kryer vepr\u00ebn penale \u201cvrasje\u201d nga neni 178 lidhur me nenin 31 t\u00eb KPRK-s\u00eb.<\/p>\n
E akuzuara Nura po ngarkohet edhe me vepr\u00ebn penale t\u00eb arm\u00ebmbajtjes pa leje, p\u00ebrkat\u00ebsisht p\u00ebr mbajtjen pa autorizim t\u00eb arm\u00ebs t\u00eb tipit TT kalib\u00ebr 7.62mm s\u00eb bashku me 19 fishek\u00eb t\u00eb cil\u00ebn arm\u00eb e ka p\u00ebrdorur si n\u00eb dispozitivin e p\u00ebrshkruar m\u00eb lart\u00eb.<\/p>\n
