N\u00eb shqyrtimin fillestar t\u00eb mbajtur t\u00eb mart\u00ebn, pas leximit t\u00eb aktakuz\u00ebs nga prokurori Naim Abazi, tre t\u00eb akuzuarit nuk e kan\u00eb pranuar faj\u00ebsin\u00eb p\u00ebr veprat me t\u00eb cilat ngarkohen, raporton \u201cBetimi p\u00ebr Drejt\u00ebsi\u201d.<\/p>\n\n\n\n

N\u00eb k\u00ebto rrethana, gjykat\u00ebsi Kujtim Krasniqi i informoi t\u00eb nj\u00ebjtit me t\u00eb drejt\u00ebn e tyre p\u00ebr t\u00eb k\u00ebrkuar hudhjen e aktakuz\u00ebs e p\u00ebr t\u00eb kund\u00ebrshtuar provat, n\u00eb afat prej 30 dit\u00ebsh..<\/p>\n\n\n\n

Prezent n\u00eb k\u00ebt\u00eb seanc\u00eb ishin edhe mbrojt\u00ebsit e t\u00eb akuzuarve, avokat\u00ebt Adem Vokshi, Florim Lata, Skender Gashi dhe Alban Arifi.<\/p>\n\n\n\n

Aktakuza ndaj Besim Tahirit, G\u00ebzim Osmanit e Hajredin Hajr\u00ebs \u00ebsht\u00eb ngritur nga Prokuroria Themelore n\u00eb Prishtin\u00eb, m\u00eb 31 maj 2021.<\/p>\n\n\n\n

Besim Tahiri akuzohet se n\u00eb cil\u00ebsin\u00eb e personit zyrtar, gjat\u00eb periudh\u00ebs kohore nga 13 maji 2016 deri 10 tetor 2017, me q\u00ebllim t\u00eb d\u00ebmtimit t\u00eb buxhetit t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, ka keqp\u00ebrdorur pozit\u00ebn zyrtare gjat\u00eb zhvillimit t\u00eb prokurimit p\u00ebr aktivitetin e prokurimit \u201cDislokomi i varrezave nga traseja e Autostrad\u00ebs R6 segmenti C2 dhe C3\u201d.<\/p>\n\n\n\n

Sipas aktakuz\u00ebs, duke vepruar n\u00eb kund\u00ebrshtim me kriteret e dosjes s\u00eb tenderit dhe njoftimit p\u00ebr kontrat\u00eb, ku ishte p\u00ebrcaktuar afati i kontrat\u00ebs 1 vit nd\u00ebrsa ka n\u00ebnshkruar kontrat\u00ebn me afat prej 2 vite, pastaj ka lejuar tejkalimin e numrit t\u00eb nj\u00ebsive nga 40 n\u00eb 474 varreza dhe ka lejuar tejkalimin e kontrat\u00ebs nga 60,000.00 euro n\u00eb 832,235.69, si dhe ka lidh aneks kontrat\u00ebn m\u00eb 30 n\u00ebntor 2016 p\u00ebr k\u00ebt\u00eb procedur\u00eb t\u00eb prokurimit n\u00eb em\u00ebr t\u00eb pun\u00ebve shtes\u00eb, edhe pse ishte n\u00eb kund\u00ebrshtim me nenin 35, paragrafi 2.4.i LPP-\u00ebs, ku vlera e k\u00ebsaj aneks kontrat\u00eb \u00ebsht\u00eb me vler\u00eb shum\u00ebfish\u00eb m\u00eb e lart\u00eb se q\u00eb \u00ebsht\u00eb e lejuar me Ligjin e Prokurimit Publik (neni 35, par 2.4), krejt kjo me q\u00ebllim p\u00ebr t\u2019i shkaktuar d\u00ebme buxhetit t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs n\u00eb shum\u00ebn prej 772.235.69 euro.<\/p>\n\n\n\n

Me k\u00ebt\u00eb, Tahiri akuzohet se ka kryer vepr\u00ebn penale \u201ckeqp\u00ebrdorim i pozit\u00ebs apo autoritetin zyrtar\u201d nga neni 422, paragrafi 1 t\u00eb Kodit Penal t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, ku kryesi d\u00ebnohet me burgim prej gjasht\u00eb (6) muaj deri n\u00eb pes\u00eb (5) vjet.<\/p>\n\n\n\n

Tutje, n\u00eb dispozitivin e dyt\u00eb t\u00eb aktakuz\u00ebs thuhet se i pandehuri G\u00ebzim Osmani, n\u00eb cil\u00ebsin\u00eb e personit zyrtar, gjat\u00eb periudh\u00ebs kohore 25 gusht 2016 e deri m\u00eb 7 n\u00ebntor 2018, me q\u00ebllim t\u00eb d\u00ebmtimit t\u00eb buxhetit t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, e ka keqp\u00ebrdor pozit\u00ebn zyrtar, n\u00eb at\u00eb m\u00ebnyr\u00eb q\u00eb ka vepruar n\u00eb kund\u00ebrshtim me detyrat dhe p\u00ebrgjegj\u00ebsit e tij t\u00eb cilat ishin caktuar me vendimin me NR.Pro.35831 t\u00eb 25 gusht 2016.<\/p>\n\n\n\n

N\u00eb aktakuz\u00eb thuhet se Osmani, n\u00eb cil\u00ebsin\u00eb e menaxherit t\u00eb projektit, ishte i obliguar q\u00eb t\u00eb sigurohej se operatori ekonomik i p\u00ebrmbushte t\u00eb gjitha obligimet e performanc\u00ebs apo d\u00ebrges\u00ebs n\u00eb p\u00ebrputhje me termat dhe kushtet e kontrat\u00ebs, t\u2019i dor\u00ebzoj\u00eb raportet mbi progresin ose kompletimin e nj\u00eb kontrate si\u00e7 k\u00ebrkohet nga divizioni i prokurimit ose nga ZKA, t\u00eb verifikoj sasit\u00eb e pun\u00ebve t\u00eb kryera, n\u00ebnshkruaj ditarin e nd\u00ebrtimit, librin e nd\u00ebrtimit dhe situatat p\u00ebr pages\u00eb. Lidhur me k\u00ebt\u00eb thuhet se i kishte shkaktuar d\u00ebm Ministris\u00eb s\u00eb Infrastruktur\u00ebs dhe p\u00ebrfitime operatorit ekonomik \u201cEurokod\u201d, me t\u00eb cilin rast jan\u00eb pranuar pun\u00ebt edhe pse nuk ishin zbatuar pozicionet e p\u00ebrcaktuara n\u00eb kontrat\u00eb, si dhe ka tejkaluar kompetencat e menaxherit t\u00eb projektit duke k\u00ebrkuar pozicione shtes\u00eb n\u00eb em\u00ebr t\u00eb aneks kontrat\u00ebs, kurse pas n\u00ebnshkrimit t\u00eb aneks kontrat\u00ebs kishte lejuar q\u00eb t\u00eb b\u00ebhen hulumtime p\u00ebr varre n\u00eb lokacione t\u00eb cilat nuk ishin p\u00ebrcaktuar n\u00eb kontrat\u00eb, krejt kjo me q\u00ebllim p\u00ebr t\u2019i shkaktuar d\u00ebme buxhetit t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs n\u00eb shum\u00ebn prej 772,235.69 euro.<\/p>\n\n\n\n

Hajredin Hajra akuzohet se n\u00eb cil\u00ebsin\u00eb e drejtorit t\u00eb biznesit \u201cEurokod\u201d SH.P.K., me q\u00ebllim t\u00eb pranimit t\u00eb ofert\u00ebs nga autoriteti kontraktues p\u00ebr aktivitetin e prokurimit me titull t\u00eb kontrat\u00ebs \u201cDislokimi i varrezave nga traseja e Autostrad\u00ebs R6, segmenti C 2 dhe C 3\u201d, m\u00eb 17 qershor 2016, n\u00eb Prishtin\u00eb, n\u00eb kund\u00ebrshtim me kriteret e dosjes s\u00eb tenderit dhe njoftimit p\u00ebr kontrat\u00eb kishte dor\u00ebzuar ofert\u00ebn n\u00eb baz\u00eb t\u00eb nj\u00eb marr\u00ebveshje t\u00eb kund\u00ebrligjshme.<\/p>\n\n\n\n

N\u00eb aktakuz\u00eb thuhet se marr\u00ebveshja p\u00ebr themelimin e grupit t\u00eb operator\u00ebve ekonomik \u201cEurokod\u201d, SH.P.K dhe \u201cEngenieering Group\u201d SH.P.K, ishte b\u00ebr\u00eb q\u00eb t\u00eb plot\u00ebsohen kriteret formale, m\u00eb sakt\u00eb t\u00eb p\u00ebrdorej referenca e \u201cEngenieering Group\u201d, kurse n\u00eb zbatim t\u00eb kontrat\u00ebs ishte p\u00ebrjashtuar operatori ekonomik \u201cEngenieering Group\u201d nga i pandehuri, me t\u00eb cilin rast nuk e kishte lejuar t\u00eb marr\u00eb pjes\u00eb n\u00eb implementim t\u00eb kontrat\u00ebs me num\u00ebr MI\/16\/071\/221, t\u00eb 20 korrik 2016, me q\u00ebllim q\u00eb vet\u00ebs t\u2019i sjell dobi pasurore.<\/p>\n\n\n\n
